【摘要】：在世界政治文明現(xiàn)代化的歷史潮流下,在我國(guó)法治建設(shè)宏觀背景下,依規(guī)治黨成為實(shí)現(xiàn)法治國(guó)家建設(shè)、推動(dòng)新形勢(shì)下黨的建設(shè)不斷向前發(fā)展的必然要求。十八屆六中全會(huì)通過(guò)的《關(guān)于新形勢(shì)下黨內(nèi)政治生活的若干準(zhǔn)則》和《中國(guó)共產(chǎn)黨黨內(nèi)監(jiān)督條例》,是新形勢(shì)下黨不斷加強(qiáng)自身建設(shè)的理論和實(shí)踐創(chuàng)新,標(biāo)志著全面從嚴(yán)治黨進(jìn)入了新的階段。此前,十八屆四中全會(huì)通過(guò)《中共中央關(guān)于全面推進(jìn)依法治國(guó)若干重大問題的決定》,明確了全面推進(jìn)依法治國(guó)的指導(dǎo)思想、總體目標(biāo)和重大任務(wù),提出了關(guān)于依法治國(guó)的一系列重大舉措。強(qiáng)調(diào)指出,依法執(zhí)政,既要求黨依據(jù)國(guó)家憲法法律治國(guó)理政,也要求黨依據(jù)黨內(nèi)法規(guī)管黨治黨。治黨依規(guī)、治國(guó)依法,這是黨帶領(lǐng)我國(guó)人民不斷進(jìn)行探索,必須長(zhǎng)時(shí)間堅(jiān)持的的一條基本經(jīng)驗(yàn)。如何正確認(rèn)識(shí)依法治國(guó)和依規(guī)治黨二者之間的關(guān)系,如何把中共中央關(guān)于從嚴(yán)治黨的重要舉措具體落到實(shí)處?本文從當(dāng)前我國(guó)法治建設(shè)現(xiàn)狀出發(fā),詳細(xì)介紹學(xué)術(shù)界對(duì)該問題的研究現(xiàn)狀。針對(duì)依規(guī)治黨提法的質(zhì)疑,從依規(guī)治黨思想的理論淵源、現(xiàn)實(shí)發(fā)展出發(fā),對(duì)其科學(xué)內(nèi)涵作出界定。搜集整理依規(guī)治黨與依法治國(guó)二者關(guān)系的相關(guān)研究,針對(duì)研究中存在的相關(guān)問題,探索依規(guī)治黨與依法治國(guó)二者協(xié)調(diào)推進(jìn)的路徑。比如,以法治精神推動(dòng)黨內(nèi)規(guī)范建設(shè),推進(jìn)黨內(nèi)法規(guī)與國(guó)家憲法法律的對(duì)接,完善法律法規(guī)的備案審查機(jī)制,推動(dòng)黨的執(zhí)紀(jì)行為法治化等。在中國(guó)社會(huì)邁向現(xiàn)代化的進(jìn)程中,黨作為帶領(lǐng)人民解決各項(xiàng)問題的中心力量,支撐著中國(guó)社會(huì)的前進(jìn)和發(fā)展,尤其是中國(guó)社會(huì)法治的前進(jìn)和發(fā)展。黨的自身建設(shè),以及如何通過(guò)依法執(zhí)政實(shí)現(xiàn)法治國(guó)家建設(shè)是當(dāng)前我們所面臨的亟待解決的重大問題。
[Abstract]:Under the historical trend of the modernization of world political civilization and the macroscopic background of the construction of rule of law in our country, governing the Party according to rules has become the inevitable requirement for realizing the construction of the country ruled by law and pushing the party building forward under the new situation.The guidelines on Inner-Party political Life under the New situation adopted by the sixth Plenary session of the 18th CPC Central Committee and the regulations on Inner-Party Supervision of the Communist Party of China are theoretical and practical innovations for the Party to constantly strengthen its own construction under the new situation.It marks a new stage in the overall strict administration of the Party.Prior to this, the fourth Plenary session of the 18th CPC Central Committee adopted the "decision of the CPC Central Committee on comprehensively promoting the ruling of the country according to Law," which defined the guiding ideology, overall objectives and major tasks of comprehensively promoting the rule of law.A series of major measures were put forward on governing the country according to law.It is emphasized that ruling by law requires both the Party to govern the country according to the state constitution and the Party to administer the party in accordance with the Party's laws and regulations.It is a basic experience for the Party to lead our people to explore and persist for a long time in running the party according to the rules and governing the country according to law.How to correctly understand the relationship between governing the country according to law and governing the Party according to rules, and how to put into practice the important measures of the CPC Central Committee on strict administration of the Party?Starting from the current situation of the rule of law construction in our country, this paper introduces in detail the research status of this problem in academic circles.In view of the question of governing the Party according to the rules, the scientific connotation is defined from the theoretical origin and the realistic development of the thought of governing the party according to the rules.This paper collects and arranges the relevant research on the relationship between governing the Party according to rules and governing the country according to law, aiming at the related problems existing in the study, and explores the way to coordinate and advance the Party according to rules and ruling the country according to law.For example, we should promote the construction of inner-party norms with the spirit of rule of law, promote the docking of inner-party laws and regulations with the national constitutional laws, perfect the mechanism of filing and examining laws and regulations, and promote the legalization of the Party's practice of discipline enforcement.In the process of the modernization of Chinese society, the Party, as the central force leading the people to solve all kinds of problems, supports the progress and development of Chinese society, especially the advancement and development of the rule of law in China.The construction of the Party itself and how to realize the construction of a country ruled by law by ruling by law are the major problems we are facing.
