【摘要】:中共十八屆六中全會提出全面從嚴治黨,要求在國有企業(yè)中,尤其要以“嚴”字當(dāng)頭,切實抓好相關(guān)領(lǐng)導(dǎo)干部的黨風(fēng)廉政建設(shè),適應(yīng)全面從嚴治黨的要求。以對領(lǐng)導(dǎo)干部的權(quán)力制約作為發(fā)展黨風(fēng)廉政建設(shè)的切入點,從嚴治理企業(yè)內(nèi)部的貪污腐敗問題。在我國現(xiàn)階段國有企業(yè)的發(fā)展過程中,由于對擁有較大權(quán)力的領(lǐng)導(dǎo)干部的相關(guān)監(jiān)督問責(zé)機制不健全,使得企業(yè)內(nèi)部的領(lǐng)導(dǎo)干部無法抵制誘惑,最終跌入腐敗甚至犯罪的深淵,造成國有企業(yè)內(nèi)部保值增長的國有資產(chǎn)大量流失。因此,對領(lǐng)導(dǎo)干部的不當(dāng)行為進行監(jiān)督問責(zé)勢在必行。目前我國關(guān)于問責(zé)制相關(guān)的研究,主要集中在政府、國家機關(guān)等行政領(lǐng)域。而與較為完善的行政問責(zé)制研究相比,國有企業(yè)領(lǐng)導(dǎo)干部問責(zé)機制的研究還處于剛開始的探索和起步階段。在深入開展調(diào)查研究的基礎(chǔ)上,闡述了相關(guān)概念和理論基礎(chǔ),包括國有企業(yè)領(lǐng)導(dǎo)干部問責(zé)機制的概念、馬克思的企業(yè)理論、人民主權(quán)理論、分權(quán)制衡理論以及程序正義理論。在此基礎(chǔ)上,明確了國有企業(yè)領(lǐng)導(dǎo)干部問責(zé)制的責(zé)任體系,全面分析了來自國有企業(yè)內(nèi)外部的監(jiān)督問責(zé)機構(gòu)對國有企業(yè)領(lǐng)導(dǎo)干部的監(jiān)督問責(zé)的現(xiàn)狀,剖析了國有企業(yè)領(lǐng)導(dǎo)干部問責(zé)監(jiān)督機制在實踐中出現(xiàn)的相關(guān)問題,讓人們進一步認識到建立健全國有企業(yè)的相關(guān)問責(zé)機制對于防范國有企業(yè)中領(lǐng)導(dǎo)干部違法行使權(quán)力的重要作用,客觀地分析和總結(jié)了問責(zé)制在實踐中產(chǎn)生困境的原因,完善問責(zé)制度,規(guī)范國有企業(yè)領(lǐng)導(dǎo)干部的行為。在對美國、德國、法國等國家國有企業(yè)領(lǐng)導(dǎo)人員監(jiān)督問責(zé)機制進行分析的基礎(chǔ)上,總結(jié)了這些國家相關(guān)制度方面的有利經(jīng)驗并立足于我國特有的政治制度,提出了對國有企業(yè)領(lǐng)導(dǎo)干部問責(zé)機制的優(yōu)化設(shè)計:一是構(gòu)建思想道德教育的預(yù)防機制,強化國有企業(yè)領(lǐng)導(dǎo)干部的政治、道德、法律以及業(yè)務(wù)方面的素質(zhì)教育,推進國有企業(yè)在廉潔治理方面的文化建設(shè);二是完善問責(zé)方面立法,通過完善外部法律法規(guī)制度來保障問責(zé)制的執(zhí)行;三是構(gòu)建內(nèi)外并重的問責(zé)機制,完善問責(zé)主體內(nèi)外部的銜接,確保問責(zé)的執(zhí)行力;四是強化問責(zé)制追究機制,明確其職權(quán)劃分、規(guī)范問責(zé)制的程序、擴大問責(zé)的范圍,通過加強各方面監(jiān)督問責(zé)機制的責(zé)任追究力度,依照黨的紀律、法律規(guī)定嚴肅查處國有企業(yè)領(lǐng)導(dǎo)干部的違紀違法行為,最終實現(xiàn)問責(zé)的效果。
[Abstract]:The sixth Plenary session of the 18 Central Committee of the Communist Party of China put forward a comprehensive and strict administration of the party, and demanded that in state-owned enterprises, in particular, the word "strict" should be used at the head, and the party style and clean government of the relevant leading cadres should be conscientiously carried out. To meet the requirements of comprehensive and strict administration of the Party, to take the power restriction of leading cadres as the starting point for the development of a clean and honest party style, and to strictly deal with the problem of corruption within enterprises. In the process of the development of state-owned enterprises in our country at the present stage, As the relevant supervisory and accountability mechanisms for leading cadres with greater power are not perfect, leading cadres within enterprises are unable to resist the temptation and eventually fall into the abyss of corruption or even crime. Therefore, it is imperative to supervise and hold accountable the misconduct of leading cadres. At present, the research on the accountability system in our country is mainly focused on the government. Compared with the more perfect research on administrative accountability, the research on the accountability mechanism of leading cadres in state-owned enterprises is still in the initial stage of exploration and starting. On the basis of in-depth investigation and research, The related concepts and theoretical basis are expounded, including the concept of the accountability mechanism of leading cadres in state-owned enterprises, Marx's enterprise theory, the theory of people's sovereignty, the theory of separation of powers and checks and balances, and the theory of procedural justice. This paper clarifies the responsibility system of leading cadres' accountability in state-owned enterprises, and comprehensively analyzes the present situation of supervision and accountability of leading cadres of state-owned enterprises by supervision and accountability institutions from inside and outside state-owned enterprises. This paper analyzes the problems related to the accountability and supervision mechanism of leading cadres in state-owned enterprises in practice. Let people further realize the important role of establishing and perfecting the relevant accountability mechanism of state-owned enterprises to prevent the leading cadres from exercising their power illegally in state-owned enterprises, and objectively analyze and summarize the reasons for the predicament of accountability system in practice. Improving the accountability system and standardizing the behavior of leading cadres in state-owned enterprises. On the basis of an analysis of the supervisory and accountability mechanisms for the leaders of state-owned enterprises in the United States, Germany, France, and other countries, This paper summarizes the beneficial experiences of the relevant systems in these countries and puts forward the optimal design of the accountability mechanism of the leading cadres in state-owned enterprises based on the unique political system of our country. The first is to construct the preventive mechanism of ideological and moral education. To strengthen the political, moral, legal and professional quality education of the leading cadres of state-owned enterprises, and to promote the cultural construction of clean governance in state-owned enterprises; and second, to improve the legislation on accountability, Through perfecting the external laws and regulations system to ensure the implementation of accountability system; third, to build both internal and external accountability mechanism, improve the internal and external accountability of the interface to ensure the implementation of accountability; fourth, strengthen accountability mechanism, To clarify the division of their functions and powers, to standardize the procedures for accountability, to expand the scope of accountability, to strictly investigate and deal with violations of discipline and law by leading cadres of state-owned enterprises, in accordance with the Party's discipline and in accordance with the Party's discipline, by strengthening the accountability mechanism for all aspects of supervision and accountability. Finally, the effect of accountability is realized.
