【摘要】：《中華人民共和國著作權(quán)法》第十條第三款中規(guī)定了著作權(quán)人可以全部或者部分轉(zhuǎn)讓相關(guān)權(quán)利。然而近年來在著作權(quán)轉(zhuǎn)讓過程中頻繁出現(xiàn)重復(fù)轉(zhuǎn)讓、多次轉(zhuǎn)讓的問題,如何才能為著作權(quán)受讓人以及第三人提供切實的保護(hù),杜絕轉(zhuǎn)讓權(quán)的濫用,本文在民法基本原理和物權(quán)變動公示規(guī)則的指導(dǎo)下,結(jié)合著作權(quán)轉(zhuǎn)讓登記的現(xiàn)有法律規(guī)定,論述現(xiàn)有制度的不足之處,明確完善著作權(quán)轉(zhuǎn)讓登記的必要性,并討論轉(zhuǎn)讓登記的效力。力圖通過完善著作權(quán)登記制度解決“一權(quán)數(shù)賣”現(xiàn)象的出現(xiàn)。正文部分?jǐn)M從以下四個方面進(jìn)行論述: 第一章從法律規(guī)定和實踐情況兩方面入手,對著作權(quán)轉(zhuǎn)讓登記的現(xiàn)狀進(jìn)行介紹。隨后,對現(xiàn)狀進(jìn)行分析,梳理出其中存在的問題。就法律規(guī)定而言,著作權(quán)轉(zhuǎn)讓登記的規(guī)定并不完全空白,目前已有關(guān)于計算機(jī)軟件著作權(quán)登記以及著作權(quán)轉(zhuǎn)讓合同備案方面的規(guī)定。法律之所以設(shè)計這些制度,是為了保障受讓人或再轉(zhuǎn)讓當(dāng)事人的權(quán)益,但由于對著作權(quán)轉(zhuǎn)讓合同備案的規(guī)定較為籠統(tǒng),在實踐中并不能有效的起到明確公示著作權(quán)人、作品、權(quán)利范圍等方面的作用。因此有必要探討如何完善著作權(quán)轉(zhuǎn)讓登記制度。 第二章從著作權(quán)轉(zhuǎn)讓范圍入手,由于轉(zhuǎn)讓范圍僅限于財產(chǎn)權(quán)部分,因此在轉(zhuǎn)讓過程中割裂了著作權(quán)人的人身權(quán)和財產(chǎn)權(quán),需要有明確的權(quán)利登記才能使第三人清楚的查實著作權(quán)的相關(guān)內(nèi)容。其次,從分析合同備案與權(quán)利登記區(qū)別角度說明現(xiàn)有的著作權(quán)轉(zhuǎn)讓合同備案規(guī)定并不能為相關(guān)人提供有利的保護(hù);因此有必要對現(xiàn)有的著作權(quán)轉(zhuǎn)讓合同的備案規(guī)定明確為對著作權(quán)權(quán)利轉(zhuǎn)讓的登記。第三章著力探討著作權(quán)轉(zhuǎn)讓登記的效力。首先從物權(quán)法的基本理論出發(fā),介紹了登記的兩種效力,再結(jié)合著作權(quán)轉(zhuǎn)讓行為的自身價值及作用,對著作權(quán)轉(zhuǎn)讓登記的效力進(jìn)行探討,論述了著作權(quán)轉(zhuǎn)讓登記對抗性效力的合理性。 第四章首先從學(xué)理的角度進(jìn)一步對著作權(quán)轉(zhuǎn)讓登記制度建立的合理性作出闡述,隨后從明確法律規(guī)定、完善登記程序等方面提出了構(gòu)建著作權(quán)轉(zhuǎn)讓登記制度的具體方法。 通過本文最終闡明建立著作權(quán)轉(zhuǎn)讓登記制度是必要的,并且明確著作權(quán)轉(zhuǎn)讓登記的效力,為保護(hù)著作權(quán)轉(zhuǎn)讓當(dāng)事人以及相關(guān)第三人提供有力的法律保障,維護(hù)著作權(quán)交易市場的穩(wěn)定性。
[Abstract]:The third paragraph of Article 10 of the copyright Law of the people's Republic of China stipulates that the copyright owner may transfer the relevant rights in whole or in part. However, in recent years, in the process of copyright transfer, the problem of repeated transfer occurs frequently, and how to provide practical protection for the copyright transferee and the third party, and prevent the abuse of the transfer right. Under the guidance of the basic principles of the civil law and the rules of publicizing the change of real right, this paper discusses the deficiencies of the existing system and the necessity of perfecting the registration of the transfer of copyright in combination with the existing legal provisions of copyright transfer registration. The validity of transfer registration is also discussed. Try to improve the copyright registration system to solve the phenomenon of "one-weight sale". The main body part from the following four aspects to discuss: the first chapter from the legal provisions and the practice of two aspects, the status quo of copyright transfer registration is introduced. Then, the present situation is analyzed and the existing problems are sorted out. As far as the legal provisions are concerned, the provisions of copyright transfer registration are not completely blank. At present, there are provisions on the registration of computer software copyright and the filing of copyright transfer contracts. The law designed these systems to protect the rights and interests of the transferee or the re-transfer party. However, because of the general provisions on the record of the copyright transfer contract, they can not effectively publicize the copyright owner or the work in practice. The role of the scope of rights, etc. Therefore, it is necessary to explore how to improve the copyright transfer registration system. The second chapter starts with the scope of copyright transfer, because the scope of transfer is limited to the part of property right, so in the process of transfer, it separates the personal right and property right of copyright owner. A clear right to register is required to enable the third party to clearly verify the copyright content. Secondly, from the point of view of analyzing the difference between contract filing and right registration, the author explains that the existing record filing provisions of copyright transfer contract can not provide beneficial protection for relevant persons. Therefore, it is necessary to record the existing contract of copyright transfer as the registration of the transfer of copyright rights. Chapter III focuses on the effectiveness of copyright transfer registration. Starting from the basic theory of property law, this paper introduces the two kinds of effectiveness of registration, and then discusses the effectiveness of copyright transfer registration by combining the value and function of copyright transfer. This paper discusses the rationality of the antagonistic effect of copyright transfer registration. The fourth chapter firstly expounds the rationality of the establishment of copyright transfer registration system from a theoretical point of view, and then puts forward the specific methods to construct the copyright transfer registration system from the aspects of clear legal provisions and perfect registration procedures. It is necessary to establish the registration system of copyright transfer through this article, and the effectiveness of copyright transfer registration is clarified to provide effective legal protection for the protection of copyright transfer parties and related third parties. To maintain the stability of the copyright trading market.
