【摘要】：繪文字是一種基于代碼產(chǎn)生的具有固定圖片尺寸的表情符號,它具有獨(dú)創(chuàng)性表達(dá)的部分應(yīng)當(dāng)受到著作權(quán)法的保護(hù)。因其在交流過程中起到補(bǔ)充情緒的作用,繪文字的著作權(quán)保護(hù)在作品類型中存在實(shí)用藝術(shù)作品和美術(shù)作品的選擇,但將繪文字歸類到美術(shù)作品更符合其發(fā)展趨勢。在許可方面,供應(yīng)商通過規(guī)制編碼和規(guī)制圖片兩種途徑來制定繪文字的許可規(guī)則,主要包括知識許可協(xié)議、分類型許可、Apache許可證。
[Abstract]:Pictorial text is a kind of emoji with fixed picture size which is generated by code, and its original expression should be protected by copyright law. Because it plays a supplementary emotional role in the process of communication, the copyright protection of pictorial text has the choice of practical art works and fine arts works in the type of works, but it is more in line with its development trend to classify pictorial characters into art works. In the aspect of license, the supplier formulates the license rules of pictorial text by regulating coding and regulating pictures, mainly including knowledge license agreement, Apache license by type.
