【摘要】: 當(dāng)今社會(huì),極具特色的高檔寫字樓,體現(xiàn)獨(dú)特人文氣息的大型雕塑雕刻組合,經(jīng)典的商家廣告,公路上疾馳而過的新概念跑車等等無處不在。人們?cè)隗@訝其奢華時(shí),往往忽視了它也是享有版權(quán)的作品。這些版權(quán)作品把我們的生活團(tuán)團(tuán)包圍住,如果某天我們用鏡頭或者其他設(shè)備來表達(dá)個(gè)人的某種感受,只要新創(chuàng)作品中涵蓋此類物件,就有可能被控侵犯他人權(quán)利。我們表達(dá)生活感想的愿望或者進(jìn)一步創(chuàng)作作品的愿望因此而被窒息或者舉步維艱。隨著科技的發(fā)展,作品的使用方式推陳出新,已經(jīng)超越了當(dāng)前我國相關(guān)法律的調(diào)整范圍。這一現(xiàn)象引起了國內(nèi)外學(xué)者的廣泛關(guān)注。目前,為解決該問題許多國家都正在推動(dòng)附帶使用制度的國內(nèi)立法,有的國家的相關(guān)立法已經(jīng)很完善了,但是我國著作權(quán)法中關(guān)于作品的附帶使用方面還處于一片空白狀態(tài)。本文通過案件引入附帶使用制度,在分析了附帶使用制度的現(xiàn)實(shí)需求和合理性以及在借鑒其他國家的立法經(jīng)驗(yàn)的基礎(chǔ)上,結(jié)合我國著作權(quán)作品使用方式調(diào)整的立法狀況和司法實(shí)踐,提出了我國作品附帶使用的立法,希望借此能夠引起立法者和法律專家、學(xué)者對(duì)該方面的重視,盡快在我國著作權(quán)法中構(gòu)建作品附帶使用制度,使作品的創(chuàng)作得以如泉水噴涌,經(jīng)濟(jì)得以健康發(fā)展。 本文除引言和結(jié)語外,共分為五部分。 第一部分介紹了我國首例涉及作品附帶使用的案件——《命運(yùn)的承諾》,包括了基本案情、案件焦點(diǎn)、爭(zhēng)議與分歧意見、引發(fā)的思考五部分。通過對(duì)案件的分析指出了該案判決的不合理之處,希望引起法律人的思考,并且引出了“附帶使用”一詞。 第二部分通過對(duì)“附帶使用”一詞的含義和性質(zhì)進(jìn)行解析,進(jìn)而介紹版權(quán)法中的“附帶使用制度”在全球的發(fā)展歷史和西方主要國家版權(quán)法中的“附帶使用制度”在司法實(shí)踐中的適用狀況,讓讀者比較清楚的理解附帶使用制度的來龍去脈。再通過把“附帶使用”與“暫時(shí)復(fù)制”和“合理使用制度”做比較,讓讀者對(duì)之有更深刻的認(rèn)識(shí)。 第三部分分析了附帶使用制度的現(xiàn)實(shí)需求和附帶使用制度的合理性。通過分析社會(huì)生活中附帶使用行為的現(xiàn)狀和目前案件審理中的尷尬現(xiàn)狀,指出了我國在著作權(quán)法中確立附帶使用制度的必要性。任何一種制度的存在都有其理論依據(jù)。通過附帶使用制度的哲學(xué)分析和經(jīng)濟(jì)學(xué)分析證明了在我國著作權(quán)法中構(gòu)建附帶使用制度的合理性和必要性。 第四部分通過對(duì)全球各國版權(quán)法或者著作權(quán)法中附帶使用制度之立法例的介紹、對(duì)比、分析和總結(jié),大體勾勒出了附帶使用制度的內(nèi)容,然后具體的分析其構(gòu)成要件,即構(gòu)成附帶使用的作品類型,主觀要件以及客觀要件。附帶使用制度的構(gòu)成要件分析比較清楚的解決了附帶使用是否成立的問題。 第五部分通過上述理論基礎(chǔ)和司法實(shí)踐的分析,對(duì)構(gòu)建我國著作權(quán)法中的附帶使用制度提出了自己的建議。
[Abstract]:In today's society, the highly featured high grade office buildings, the large sculptures and carvings that embody the unique humanistic atmosphere, the classic commercial advertisements, the fast new concept sports cars on the road, and so on. People often ignore that it is also a copyrighted work when they are extravagant. These copyrighted works encircled our life. If one day we use a lens or other equipment to express a personal feeling, as long as a new creation covers such objects, it is possible to be accused of violating the rights of others. It has transcended the current adjustment of relevant laws in China. This phenomenon has aroused wide attention of scholars both at home and abroad. At present, in order to solve the problem, many countries are promoting the domestic legislation of the incidental use system, and the relevant legislation in some countries has been perfected, but the copyright law of our country is about to do it. The incidental use of the product is still in a blank state. This article introduces the system of incidental use through the case, analyzes the realistic demand and rationality of the incidental use system, and on the basis of reference to the legislative experience of other countries, and combines the legislative situation and judicial practice of the use mode of our copyright works, and puts forward our country. The legislation that is used incidental to the work is hoped to cause the legislator and the legal expert, the scholar to pay attention to this aspect, to construct the work incidental system in the copyright law of our country as soon as possible, so that the creation of the works can be spewed up like the spring water, and the economy can develop healthily.
In addition to the introduction and conclusion, this article is divided into five parts.
The first part introduces the first case involving the incidental use of the works in our country, the promise of fate, which includes five parts of the basic case, the focus of the case, the dispute and the disagreement, and the thought of the case, and points out the unreasonable of the case by the analysis of the case, and hopes to lead to the thinking of the legal person, and leads to the "incidental use". "A word.
The second part analyzes the meaning and nature of the word "incidental use", and then introduces the application of the "incidental use system" in the global development history and the "incidental use system" in the copyright law of the western major countries in the copyright law, so that the reader can understand the incidental use system more clearly. By comparing the "collateral use" with "temporary duplication" and "fair use system", readers can have a deeper understanding of the dragon.
The third part analyzes the actual demand of the incidental use system and the rationality of the incidental use system. Through the analysis of the present situation of the incidental use behavior in the social life and the embarrassing situation in the case trial, it points out the necessity of establishing the incidental use system in the copyright law of our country. According to the philosophical analysis and economic analysis of the collateral use system, it is proved that it is reasonable and necessary to construct the collateral use system in our copyright law.
The fourth part, through the introduction, comparison, analysis and summary of the legislation of the incidental use of copyright law or copyright law in the world, outlines the contents of the incidental use system, and then analyzes its constituent elements concretely, that is, the types of works that are used in incidental use, the subjective elements and the objective elements. The analysis of constitutive requirements clears up the question of whether the collateral usage is valid.
The fifth part, through the analysis of the above theoretical basis and judicial practice, puts forward some suggestions for the construction of the collateral use system in China's copyright law.
