【摘要】：古籍點校作品的著作權法律問題不是著作權領域的常見問題,卻是疑難問題。正因其疑難而卓顯影響重大。分析并且處理好古籍點校作品的著作權,對于實踐中的特殊類型作品的著作權司法保護具有指導意義。具有獨創(chuàng)性是作品能夠獲得著作權保護的充分必要條件。獨創(chuàng)性應從作品的表達中尋找判斷。文章以一般作品獨創(chuàng)性的判斷標準為指引,從整理者對古籍作品整理體例的獨創(chuàng)安排、考證、選取史實,以及進行獨創(chuàng)的組合、編排而使得古籍能夠恢復原貌并便于今天的讀者閱讀理解等方面分析了古籍點校作品的獨創(chuàng)性。因此古籍點校作品構成了法律意義上的作品,具有可版權性并適用著作權法的保護。但這并不意味著所有的點校結果都受著作權法的保護,對古籍點校作品給予著作權保護,也并不意味著對古籍本身實施了著作權保護。在判斷古籍點校作品的獨創(chuàng)性時,必須堅持具體作品具體分析的基本思路。
[Abstract]:The legal problem of copyright of ancient school works is not a common problem in the field of copyright, but a difficult problem. It is of guiding significance for judicial protection of copyright of a particular type of work in practice. Originality is a necessary and sufficient condition for a work to obtain copyright protection. Originality should be judged from the expression of a work. Guided by the criterion of originality in general works, From the original arrangement, textual research, selection of historical facts, and original combination of the collation of ancient books, The arrangement enables the ancient books to restore their original appearance and to facilitate the readers' reading and understanding today, and analyzes the originality of the works of the ancient books and schools, so that the works of the ancient books and schools constitute the works in the legal sense. It is copyrightable and protected by copyright law. However, this does not mean that all the results of dot schools are protected by copyright law. It does not mean that the copyright protection is carried out on the ancient books themselves. In judging the originality of the works of ancient books, we must adhere to the basic idea of concrete analysis of the concrete works.
