大型建設(shè)項(xiàng)目EPC合同爭(zhēng)端預(yù)警管理體系研究

【摘要】:EPC總承包在所有的總承包模式中最具代表性,并且是使用最頻繁的總承包合同之一,尤其是在國(guó)際工程承包中運(yùn)用最為普遍。自2003年原建設(shè)部30號(hào)文件頒發(fā)之后,EPC總承包越來(lái)越受到國(guó)內(nèi)發(fā)包方的采用。EPC總承包是指工程總承包企業(yè)按照合同約定,承擔(dān)工程項(xiàng)目的設(shè)計(jì)、采購(gòu)、施工、試運(yùn)行服務(wù)等工作,并對(duì)承包工程的質(zhì)量、安全、工期、造價(jià)全面負(fù)責(zé)。但在實(shí)際運(yùn)用當(dāng)中,管理者要處理很多潛在的問(wèn)題,其中EPC合同爭(zhēng)端問(wèn)題尤為突出。首先,對(duì)EPC合同的特點(diǎn)及分類(lèi)、引發(fā)爭(zhēng)端原因、爭(zhēng)端的特點(diǎn)及分類(lèi)、EPC合同基本信息分析和爭(zhēng)端預(yù)警現(xiàn)狀進(jìn)行分析,分析結(jié)果體現(xiàn)出EPC合同易于產(chǎn)生爭(zhēng)端。其次,研究了EPC合同解決爭(zhēng)端成本的構(gòu)成和產(chǎn)生爭(zhēng)端的后果,表明EPC合同一旦產(chǎn)生爭(zhēng)端,將會(huì)給合同雙方帶來(lái)嚴(yán)重的后果并且代價(jià)極其嚴(yán)重。再次,為了預(yù)防、警告和跟蹤爭(zhēng)端,根據(jù)爭(zhēng)端產(chǎn)生某些征兆性比較強(qiáng)的信息、產(chǎn)生爭(zhēng)端的原因和EPC合同自身特點(diǎn),綜合運(yùn)用推理理論、粗糙集理論、熵權(quán)法和歐氏距離檢索法構(gòu)建定性與定量相集成的案例推理與規(guī)則推理相融合(CCBR+RBR)模型來(lái)預(yù)防和警告有可能發(fā)生的爭(zhēng)端并進(jìn)行實(shí)時(shí)跟蹤。進(jìn)而,在CBR+RBR模型基礎(chǔ)上,增加枚舉法對(duì)EPC合同可能產(chǎn)生爭(zhēng)端的關(guān)鍵因素進(jìn)行分析,通過(guò)實(shí)時(shí)控制關(guān)鍵因素對(duì)EPC合同進(jìn)行爭(zhēng)端預(yù)警。最后,通過(guò)案例分析來(lái)驗(yàn)證模型對(duì)EPC合同爭(zhēng)端預(yù)警的實(shí)現(xiàn);谏鲜龇椒,組建了由業(yè)主、總承包和DAB爭(zhēng)端裁決委員會(huì)三方聯(lián)合構(gòu)成的爭(zhēng)端預(yù)警小組并且設(shè)計(jì)了矩陣式人員職責(zé)劃分。該小組具有“三方聯(lián)動(dòng)”的作用,可以達(dá)到“3+14”的管理效果。
[Abstract]:EPC general contracting is the most representative of all general contracting modes, and it is one of the most frequently used general contracting contracts, especially in international engineering contracting. Since the issuance of the document No. 30 of the former Ministry of Construction in 2003, the EPC general contract has been adopted by the domestic contracting parties more and more. EPC general contracting means that the general contracting enterprises undertake the design, procurement, construction, trial operation and other services of the project in accordance with the contract. And the quality of the contract project, safety, duration, cost of the overall responsibility. But in practice, managers have to deal with many potential problems, especially EPC contract disputes. Firstly, the characteristics and classification of EPC contracts, the causes of disputes, the characteristics and classification of disputes, the basic information analysis of EPC contracts and the current situation of dispute warning are analyzed. The results show that EPC contracts are prone to disputes. Secondly, the paper studies the composition of the dispute settlement cost and the result of the dispute in the EPC contract. It shows that once the dispute arises in the EPC contract, it will bring serious consequences to both parties and the cost will be extremely serious. Thirdly, in order to prevent, warn and follow up disputes, according to the information of some symptoms, the causes of disputes and the characteristics of EPC contracts, the reasoning theory and rough set theory are used synthetically. Entropy weight method and Euclidean distance Retrieval (Euclidean distance Retrieval) method are used to construct a (CCBR RBR) model which integrates qualitative and quantitative case-based reasoning and rule-based reasoning to prevent and warn possible disputes and to track them in real time. Furthermore, on the basis of CBR RBR model, adding enumeration method is used to analyze the key factors that may lead to disputes in EPC contracts, and to forewarn the disputes of EPC contracts by controlling key factors in real time. Finally, the paper verifies the realization of EPC contract dispute early warning by case analysis. Based on the above method, a dispute early warning group composed of owner, general contract and DAB dispute adjudication committee is set up and a matrix division of personnel duties is designed. The group has the function of "tripartite linkage" and can achieve the management effect of "3-14".
