【摘要】：正水電工程風(fēng)險包含發(fā)包人風(fēng)險和承包人風(fēng)險,按法律規(guī)定,風(fēng)險的承擔應(yīng)是公平、對等的,但在我國現(xiàn)階段建設(shè)工程處于賣方市場的條件下,發(fā)包人對風(fēng)險條款的設(shè)置一般存在著對承包人不公平現(xiàn)象。隨著社會的發(fā)展,發(fā)承包雙方終回歸到平等的環(huán)境,那么工程招標文件中如何合理的設(shè)定風(fēng)險分攤原則就顯得非常重要。本文結(jié)合在溪洛渡、烏東德水電站從事合同管理工作的經(jīng)歷并借鑒參與烏東德水電站招標文件審查時各專家的意見進行展開,重點是對合同中各方
[Abstract]:The risk of normal hydropower project includes the risk of the contractor and the risk of the contractor. According to the law, the risk bearing should be fair and equal, but at the present stage in our country, the construction project is in the condition of the seller's market. Generally speaking, the setting of risk clause by the contractor is unfair to the contractor. With the development of society, both parties return to equal environment, so it is very important how to set up the principle of risk allocation in the bidding documents. Based on the experience of contract management in Xiluodu and Wudongde Hydropower Station and drawing on the opinions of experts when participating in the examination of bidding documents of Udongde Hydropower Station, the emphasis is on the parties in the contract.
