【摘要】：本文系統(tǒng)研究了我國煤層氣的產(chǎn)業(yè)運行規(guī)則,分析了執(zhí)行中存在的四個主要問題,探討了四個完善方向。1我國已經(jīng)出臺了數(shù)十部與煤層氣開發(fā)利用有關(guān)的法律(法規(guī))和國家行政管理文件,有力保障了產(chǎn)業(yè)的正常運轉(zhuǎn)。2四個問題:一是包括煤炭法和土地法在內(nèi)的法律(法規(guī))不健全;二是部分產(chǎn)業(yè)扶持政策不完善、執(zhí)行效果不理想;三是部分行政管理手段不到位、結(jié)果不理想;四是部分監(jiān)管的手段與力度偏軟。3四個完善方向是:一是需要修訂煤炭法,需要土地管理部門支持煤層氣開發(fā)的多種用地方式;二是需要調(diào)整開發(fā)補貼、所得稅和增值稅等產(chǎn)業(yè)扶持政策;三是需要完善與簡化包括礦業(yè)權(quán)與行政審批在內(nèi)的行政管理改革;四是需要加大包括礦業(yè)權(quán)、氣價、財政補貼、對外合作和安全生產(chǎn)在內(nèi)的監(jiān)管體系建設(shè)。
[Abstract]:In this paper, the industrial operation rules of coalbed methane in China are systematically studied, and four main problems existing in the implementation are analyzed.Having discussed the four directions of perfection, China has issued dozens of laws (regulations) and national administrative documents related to the development and utilization of coalbed methane.It can guarantee the normal operation of the industry. 2. The four problems are as follows: first, the laws (regulations) including the coal law and the land law are not perfect; the second, the partial industry support policy is not perfect, and the implementation effect is not satisfactory;Third, some administrative means are not in place, the results are not ideal; fourth, the means and intensity of partial supervision are soft. 3. The four perfect directions are as follows: first, the coal law needs to be revised, and the land management departments need to support a variety of land use ways to develop coalbed methane;Second, the need to adjust development subsidies, income tax and value-added tax and other industrial support policies; third, the need to improve and simplify administrative management reform, including mining rights and administrative examination and approval; and fourth, the need to increase subsidies, including mining rights, gas prices, and financial subsidies.Construction of supervision system including foreign cooperation and production safety.
