【摘要】:正編者按:在刑法教義學(xué)的理論視域中,被害人教義學(xué)是頗具特色的子學(xué)科,其溯源于犯罪學(xué)中的被害人學(xué),從被害人視角切入刑法問題,將傳統(tǒng)的行為人單維視角的理解模式,改變?yōu)?行為人-被害人"雙維視角的理解模式,F(xiàn)階段我國刑法學(xué)界對被害人教義學(xué)的研究還不是很充分,相對集中在詐騙、非法集資等行為人與被害人互動明顯的具體案件中的被害人研究,以及被害人需保護(hù)性減損情形下的責(zé)任承擔(dān)與量刑等方面。隨著科技與社會的發(fā)展,刑法教義學(xué)理論上所進(jìn)行的相應(yīng)調(diào)整,總體而言是從預(yù)防有效性的角度重新進(jìn)行風(fēng)險分配。社會成員尤其是經(jīng)濟(jì)生活、網(wǎng)絡(luò)生活的參與者將面臨新一輪的責(zé)任調(diào)整,"受害者"也將面臨新的責(zé)任分擔(dān),即從刑事政策展開,考察被害人予以刑法
[Abstract]:The positive editor's note: in the theoretical perspective of the doctrine of criminal law, victim dogmatism is a characteristic sub-discipline, which is traced back to the victimology of criminology and cuts into the criminal law from the perspective of the victim. The traditional understanding mode of the one-dimensional angle of view of the perpetrator is changed into that of the two-dimensional perspective of "the actor and the victim". At present, the research on the dogmatics of the victim in the field of criminal law in our country is not very sufficient, and it is relatively concentrated on fraud. With the development of science and technology and the development of society, the author of illegal fund-raising and other actors have obvious interaction with the victim in the specific case of victim research, as well as the responsibility and sentencing of the victim under the circumstances of protective derogation. The corresponding adjustment in the theory of the doctrine of criminal law is, in general, the redistribution of risks from the perspective of the effectiveness of prevention. Participants in network life will face a new round of responsibility adjustment, "victims" will also face a new burden sharing, that is, from the criminal policy, the investigation of victims to the criminal law
