【摘要】：建設(shè)工程一般采用公開招標的形式組織進行，一方面可以通過淘汰機制，選取優(yōu)秀的承包商，保證工程質(zhì)量，另外一方面，還可以有效遏制招投標過程中的不規(guī)范現(xiàn)象，因此建設(shè)工程項目招投標對整個行業(yè)的發(fā)展，乃至整個社會經(jīng)濟的順利運行都有積極的作用。 然而，招投標活動在實施過程中會產(chǎn)生諸多問題，包括圍標、串標、陪標、肢解工程，規(guī)避招標等等，會滋生很多問題，違背了招投標的本意。本文從招投標常見問題來加以分析、研究，如：招投標的操作程序改進、招投標的制度建設(shè)、評標辦法的合理性研究、風(fēng)險管理機制以及工程量清單招標等方面，從不同的角度、不同的環(huán)節(jié)，對如何規(guī)范招投標市場，使整個行業(yè)朝良性發(fā)展。 招標的最終目的是通過招標完成整個項目的合理優(yōu)化采購，其含義包括最初階段要約條件的設(shè)置，以及最終合同履行階段對招標項目所確定的合同的履行情況，，招標所有條件、過程設(shè)定的目的主要是為招標項目選擇一個合理、優(yōu)化的合同，所以設(shè)定的標準既要求在招標過程中規(guī)則對合同條款進行合理、嚴謹周全的設(shè)定，又要求對于合同變更條件具有嚴格意義的設(shè)定，這些招標活動中的規(guī)則均應(yīng)在合同履行過程中得到完全的履行，否則會對整個工程管理帶來一定的負面影響。 本文將列舉一些實際案例加以分析研究，對招投標過程中的常見問題一一列舉，為規(guī)范整個市場起到一定積極推進作用。
[Abstract]:Construction projects are generally organized in the form of public bidding. On the one hand, they can, through the elimination mechanism, select excellent contractors to ensure the quality of the project. On the other hand, they can also effectively curb the non-standard phenomenon in the bidding process. Therefore, construction project bidding plays a positive role in the development of the whole industry and even the smooth operation of the whole society and economy. However, bidding activities in the implementation process will produce a lot of problems, including the surrounding bid, string bid, accompany bid, dismemberment project, circumvent bidding and so on, will breed a lot of problems, contrary to the original intention of bidding. This paper analyzes and studies the common problems in bidding, such as the improvement of bidding procedure, the construction of bidding system, the rationality of bid evaluation methods, the risk management mechanism and the bidding of bill of quantities, and so on. From different angles, different links, how to regulate the bidding market, make the whole industry toward benign development. The ultimate purpose of the tender is to complete the reasonable and optimized procurement of the whole project through bidding. Its meaning includes the setting of the terms of the offer at the initial stage, the performance of the contract determined in the final stage of the performance of the contract for the bidding project, and all the conditions of the tender, The purpose of the process setting is mainly to select a reasonable and optimized contract for the bidding project. Therefore, the set standards not only require the rules to set the terms of the contract reasonably and carefully during the bidding process, It is also required that the rules in these bidding activities should be fully fulfilled in the process of contract performance, otherwise it will bring certain negative effects to the whole project management. This paper enumerates some practical cases to analyze and study, enumerates one by one the common problems in the process of bidding, and plays a positive role in standardizing the whole market.
