工程招投標(biāo)中的違規(guī)行為及解決對策研究

【摘要】:招標(biāo)投標(biāo)交易制度從上世紀(jì)八十年代初開始在我國建筑領(lǐng)域引進應(yīng)用,經(jīng)過三十多年的發(fā)展,取得了相當(dāng)不錯的成果。實踐證明,招投標(biāo)制度的實行很大程度上規(guī)范了我國工程經(jīng)濟建設(shè)活動,對國有資金以及社會公共資源的合理分配利用、保證工程項目建設(shè)質(zhì)量起到了重要的作用,為我國社會經(jīng)濟的發(fā)展立下了汗馬功勞。但是同時我們也應(yīng)該認(rèn)識到,在這三十多年的發(fā)展歷程中,因為我國國情及社會環(huán)境的原因所導(dǎo)致的各種違規(guī)行為也是日益頻繁,比如典型的圍標(biāo)、串標(biāo)以及陰陽合同等等,讓招投標(biāo)制度的實際效果遭到了嚴(yán)重的削弱。雖然國家相關(guān)主管部門以及各地方政府陸續(xù)針對問題的出現(xiàn)也制定了相應(yīng)的對策,在一定程度上對這些違規(guī)行為起到了遏制作用,但收效不大,違規(guī)行為反而已經(jīng)有日益猖獗的跡象。 自從改革開放以來,我國的經(jīng)濟得到了快速的增長,尤其是建筑行業(yè)可以說是占據(jù)了相當(dāng)?shù)谋戎?所以面對日益突出的招投標(biāo)違規(guī)行為,切不可掉以輕心。而招投標(biāo)制度已經(jīng)是建筑經(jīng)濟發(fā)展的主要形式,如何完善及規(guī)范招投標(biāo)活動,事關(guān)整個建筑市場能否持續(xù)公平公正健康發(fā)展的大局。我國的社會主體制度是公有制,所以絕大多數(shù)項目都是政府以及公共建設(shè)項目,而這些項目正是違規(guī)行為的重災(zāi)區(qū),隨時沖擊著我國經(jīng)濟發(fā)展的安全。我國的經(jīng)濟發(fā)展正處于二次改革的關(guān)鍵十字路口,稍有不慎,將給我國整個經(jīng)濟發(fā)展帶來災(zāi)難性影響,所以國家和社會必須要這些問題加以重視,并加快招投標(biāo)制度改革,以及加快制定完善與招投標(biāo)相配套的管理規(guī)章制度步伐。 本文通過對前輩學(xué)者們大量相關(guān)文獻資料的分析的前提下,并結(jié)合實際,將我國招投標(biāo)實施過程存在的各種問題進行歸納總結(jié),并對具有代表性的典型案件進行論證分析,最后從本質(zhì)上去研究探討這些問題發(fā)生的原因以及對我國經(jīng)濟發(fā)展的危害,從而更好地針對這些問題提出相對應(yīng)的防范以及解決對策。希望本文針對招投標(biāo)活動過程中的違規(guī)行為的研究對策能夠?qū)ξ覈恼型稑?biāo)發(fā)展模式起到思路拓展的作用。
[Abstract]:The system of bidding and bidding has been introduced and applied in the field of construction in our country since the beginning of the eighties of last century. After more than 30 years of development, quite good results have been obtained. Practice has proved that the implementation of the bidding system has to a large extent standardized the construction activities of engineering in China, and has played an important role in the rational distribution and utilization of state-owned funds and social public resources, and in ensuring the construction quality of engineering projects. For the social and economic development of our country set up the credit. However, at the same time, we should also realize that in the course of more than 30 years of development, due to the national conditions and the social environment of our country, various illegal behaviors have become increasingly frequent, such as typical marking, string marking, Yin and Yang contracts, and so on. The actual effect of the bidding system has been seriously weakened. Although the relevant national authorities and local governments have formulated corresponding countermeasures against the emergence of the problem one after another, to a certain extent, they have played a role in deterring these violations, but the results have not been very effective. On the contrary, irregularities are showing signs of becoming increasingly rampant. Since the reform and opening up, China's economy has been rapid growth, especially the construction industry can be said to occupy a considerable proportion, so in the face of increasingly prominent bidding violations, we must not take lightly. The bidding system is already the main form of the construction economy development. How to perfect and standardize the bidding activities is related to the overall situation whether the whole construction market can continue to develop in a fair and healthy way. The social main body system of our country is public ownership, so most of the projects are government and public construction projects, and these projects are the most serious disaster areas of illegal behavior, which impact the security of our country's economic development at any time. The economic development of our country is at the key crossroads of the second reform. A little carelessness will have a disastrous impact on the whole economic development of our country. Therefore, the state and society must attach importance to these problems and speed up the reform of the bidding system. And to speed up the establishment of a complete set of bidding and management rules and regulations. On the premise of analyzing a large number of related documents and materials of the predecessors and combining with the practice, this paper sums up and summarizes the problems existing in the implementation process of bidding in our country, and demonstrates and analyzes the representative typical cases. Finally, the paper studies the causes of these problems and the harm to the economic development of our country from the essence, and puts forward the corresponding prevention and solution to these problems better. It is hoped that the research countermeasures of this paper can play an important role in expanding the development mode of bidding in China.
