【摘要】：工程量清單計(jì)價(jià)模式在我國(guó)建設(shè)工程項(xiàng)目中已廣泛使用，與之配套的施工合同卻是在定額計(jì)價(jià)模式下產(chǎn)生的。我國(guó)現(xiàn)階段仍廣泛使用的《建設(shè)工程施工合同》（示范文本）（以下簡(jiǎn)稱《示范文本》）是建設(shè)部、國(guó)家工商行政管理局在1999年12月頒布的。在工程量清單計(jì)價(jià)模式下，施工合同管理的研究卻沒(méi)有跟上計(jì)價(jià)模式轉(zhuǎn)變的步伐。目前，在我國(guó)還沒(méi)有一套與工程量清單計(jì)價(jià)模式配套的《建設(shè)工程施工合同》，在這樣的情況下，在工程量清單計(jì)價(jià)模式下來(lái)研究施工合同管理就顯得勢(shì)在必行了。 本文首先對(duì)國(guó)內(nèi)外施工合同管理現(xiàn)狀進(jìn)行比較，揭示了我國(guó)施工合同管理的不足之處，并且提出了研究的意義和本文研究的思路及方法。通過(guò)對(duì)工程量清單計(jì)價(jià)模式和建設(shè)工程施工合同管理程序、作用及意義的論述，以及對(duì)工程量清單計(jì)價(jià)和施工合同管理的研究，分析工程量清單計(jì)價(jià)模式下施工合同管理現(xiàn)階段存在的一些問(wèn)題。在工程量清單計(jì)價(jià)模式的環(huán)境下，對(duì)施工合同管理進(jìn)行研究，針對(duì)實(shí)際工程中施工合同管理與工程量清單計(jì)價(jià)模式存在差異和不相適應(yīng)的地方，結(jié)合九部委的《標(biāo)準(zhǔn)施工招標(biāo)文件》及國(guó)際通用的《土木工程施工合同條件》(簡(jiǎn)稱FIDIC合同條件)，通過(guò)相應(yīng)條款的對(duì)比分析，借鑒《標(biāo)準(zhǔn)施工招標(biāo)文件》和FIDIC條款對(duì)《示范文本》提出相應(yīng)的改善意見(jiàn)，進(jìn)而為修改和完善工程量清單計(jì)價(jià)模式下的《建設(shè)工程施工合同》提供相應(yīng)的指導(dǎo)和參考。 本文從第三方的角度，以客觀、公正的分析方法，對(duì)工程量清單計(jì)價(jià)模式下的施工合同管理中的工程合同價(jià)款，工程價(jià)格的調(diào)整、相關(guān)的變更調(diào)價(jià)，以及工程擔(dān)保條款、工程預(yù)付款、工程質(zhì)量保修金等多項(xiàng)相關(guān)條款進(jìn)行了分析解剖。對(duì)《建設(shè)工程工程量清單計(jì)價(jià)規(guī)范》與《示范文本》中合同價(jià)款方式的約定的不統(tǒng)一，工程價(jià)格調(diào)整時(shí)依據(jù)的文件順序不一致，，變更調(diào)價(jià)條款中對(duì)主體表述的不嚴(yán)謹(jǐn)，工程擔(dān)保條款和質(zhì)量保修金條款的不具體以及工程預(yù)付款在時(shí)間約定上的矛盾等一系列問(wèn)題，借鑒相關(guān)的《標(biāo)準(zhǔn)施工招標(biāo)文件》及國(guó)際通用的FIDIC合同條款，提出相應(yīng)的修改意見(jiàn)，并結(jié)合實(shí)例論證了相應(yīng)條款改善的效果。為工程量清單計(jì)價(jià)模式下的施工合同管理的完善提出建設(shè)性的意見(jiàn)，為解決施工合同與工程量清單計(jì)價(jià)模式的統(tǒng)一和匹配提供思路。
[Abstract]:BOQ valuation model has been widely used in the construction project of our country, the construction contract is matched in quota valuation mode. At present we use the "construction contract" (model version) (hereinafter referred to as the "model text") is the Ministry of construction, State Administration Industrial and Commercial Bureau enacted in December 1999. In the bill of quantities mode, study on construction contract management has not kept pace with the pace of change in thevaluation mode. At present, in China there is still no pricing model supporting the construction project construction contract < > a bill of quantities, in this case, in the bill of quantities study on construction contract management mode is imperative.
This paper first compares the domestic and foreign construction contract management status, reveals the shortcomings of China's construction contract management, and puts forward some ideas and methods and the significance of my study. Based on the engineering bill pricing model and construction contract management procedures, the role and significance of the paper, as well as on the bill of quantities the construction and management of the contract, analyzing some problems of BOQ valuation model of construction contract management at the present stage. In the boqmodel environment, research on construction contract management, contract management and the mode of valuation with bill of quantities are different and not adapt to the local construction in engineering practice according to the nine ministries "standard construction tender documents and international general > > < civil engineering construction contract conditions (FIDIC contract conditions), through the corresponding clause of Based on the standard construction bidding documents and FIDIC clauses, the corresponding improvement suggestions are put forward for the < model text >, which provides guidance and reference for revising and improving the < < Construction Engineering Contract > > under the valuation mode of bill of quantities.
In this paper, from the angle of the third party, with an objective, impartial analysis method, the bill of quantities of construction contract management mode of engineering project contract price, price adjustment, price adjustment related changes, and engineering guarantee terms, engineering advances, engineering quality and other relevant provisions of Xiu Jin of anatomy.
