【摘要】：人類基因編輯技術(shù)取得了巨大進(jìn)步,但也同時(shí)給我們所處的時(shí)代帶來了多維風(fēng)險(xiǎn)。針對人類基因編輯技術(shù)上的不確定性風(fēng)險(xiǎn)、倫理性風(fēng)險(xiǎn)、公平性風(fēng)險(xiǎn)以及合法性風(fēng)險(xiǎn),應(yīng)分別確定法律規(guī)制的基本原則和重點(diǎn)措施。我國目前對人類基因技術(shù)問題的法律規(guī)范體系尚存不足,特別是基因權(quán)利立法基本闕如,整體上對人類基因編輯技術(shù)的法律監(jiān)管和倫理控制相對寬松。未來應(yīng)形成能夠與倫理規(guī)范有效結(jié)合的基因技術(shù)規(guī)制的法律體系,盡快制定人類基因資源管制法,更要在民法典中形成基因權(quán)利保護(hù)法。要在研究自由、技術(shù)進(jìn)步和風(fēng)險(xiǎn)防范、權(quán)利保護(hù)等方面予以衡平考量,以維護(hù)人的尊嚴(yán)、自由和社會安全,避免基因成為人類社會不平等的新根源。
[Abstract]:Human gene editing technology has made great progress, but it also brings multidimensional risks to our time. In view of the uncertain risk, ethical risk, fairness risk and legitimacy risk of human gene editing technology, the basic principles and key measures of legal regulation should be determined respectively. At present, the legal standard system of human genetic technology in our country is still insufficient, especially the legislation of genetic rights is basically absent, and the legal supervision and ethical control of human gene editing technology are relatively loose as a whole. In the future, we should form a legal system of gene technology regulation which can be effectively combined with ethical norms, formulate the law of human genetic resources control as soon as possible, and form the protection law of genetic rights in the civil code. It is necessary to consider freedom of research, technological progress and risk prevention, protection of rights and so on in order to safeguard human dignity, freedom and social security, and to avoid genes becoming a new source of inequality in human society.
