【摘要】：本文梳理了國(guó)際海事公約中的港口國(guó)監(jiān)督檢查條款,明確海事法律法規(guī)賦予港口國(guó)的權(quán)力與職責(zé),與目前海事履職情況進(jìn)行對(duì)比,并將相關(guān)國(guó)際公約進(jìn)行匯總編寫形成對(duì)外國(guó)籍船舶監(jiān)督檢查指南。同時(shí)梳理當(dāng)前國(guó)內(nèi)對(duì)船舶監(jiān)督檢查開展形式和現(xiàn)狀,結(jié)合發(fā)達(dá)國(guó)家對(duì)外國(guó)籍船舶實(shí)行統(tǒng)一監(jiān)督執(zhí)法的特點(diǎn),提出統(tǒng)一監(jiān)督管理的新理念。 本文以外國(guó)籍船舶為出發(fā)點(diǎn),以聯(lián)合國(guó)海洋法公約等相關(guān)法律為依據(jù),就外國(guó)籍船舶開展港口國(guó)監(jiān)督檢查的相關(guān)要求進(jìn)行了詳細(xì)的分析和深入的研究。根據(jù)層次分析法得出了海事執(zhí)法能力的綜合評(píng)價(jià)指標(biāo)體系,選取三大類十個(gè)因素作為綜合評(píng)價(jià)指標(biāo),結(jié)合模糊綜合評(píng)價(jià)法對(duì)海事執(zhí)法能力進(jìn)行了綜合評(píng)價(jià),首先確定評(píng)估模型,將海事執(zhí)法能力的評(píng)價(jià)等級(jí)劃分為七個(gè)等級(jí),作為評(píng)價(jià)的標(biāo)準(zhǔn),在此基礎(chǔ)上進(jìn)行評(píng)價(jià)集以及評(píng)價(jià)指標(biāo)隸屬度的確定,通過(guò)模糊算子以及反模糊化處理之后得出了海事執(zhí)法能力的最終得出了評(píng)價(jià)結(jié)果,以某海事局為例進(jìn)行了海事執(zhí)法能力的綜合評(píng)價(jià),研究結(jié)果就外國(guó)籍船舶進(jìn)行統(tǒng)一執(zhí)法形式提供了一定的指導(dǎo)和借鑒意義,對(duì)服務(wù)型、責(zé)任型政府建設(shè),對(duì)建立一支高素質(zhì)精英中國(guó)船舶監(jiān)督執(zhí)法隊(duì)伍具有重要意義。
[Abstract]:This paper combs the port state supervision and inspection clauses in the international maritime conventions, clarifies the powers and duties of the port states under the maritime laws and regulations, and compares them with the current maritime performance. And compile the relevant international conventions to form a guide for the supervision and inspection of foreign ships. At the same time, combing the current domestic forms and present situation of ship supervision and inspection, and combining with the characteristics of unified supervision and enforcement of foreign vessels by developed countries, A new concept of unified supervision and management is put forward. This article takes the foreign ships as the starting point, takes the United Nations Convention on the Law of the Sea and other relevant laws as the basis, This paper makes a detailed analysis and in-depth study on the requirements of port state supervision and inspection of foreign vessels. According to the Analytical hierarchy process, the comprehensive evaluation index system of maritime law enforcement capability is obtained. This paper selects three categories and ten factors as comprehensive evaluation indexes, and combines fuzzy comprehensive evaluation method to evaluate maritime law enforcement capability. Firstly, the evaluation model is determined, and the evaluation level of maritime law enforcement ability is divided into seven grades. As the evaluation standard, the evaluation set and the membership degree of the evaluation index are determined on this basis, and the final evaluation results are obtained through fuzzy operator and anti-fuzzy processing. Taking a maritime affairs bureau as an example, the comprehensive evaluation of maritime law enforcement capacity is carried out. The results of the study provide certain guidance and reference significance for the unified law enforcement form of foreign ships, and it can be used for reference in the construction of service-oriented and responsibility-oriented government. It is of great significance to establish a high-quality elite Chinese ship supervision and law enforcement team.
