【摘要】:實行責權(quán)利相對統(tǒng)一的項目法人制,推進我國公路建設(shè)管理精細化、規(guī)范化、標準化、信息化的進程,為我國公路建設(shè)實現(xiàn)跨越式發(fā)展目標提供不竭動力。但是,在我國公路建設(shè)實踐中,仍然存在著項目法人概念不清晰,認定程序不夠規(guī)范,資格管理不夠明確以及考核監(jiān)督體系不健全等問題。本文以政府投資性公路建設(shè)項目法人組織機構(gòu)為研究對象,進行了以下幾個方面的研究:(1)論述了項目法人組織機構(gòu)研究的背景和意義,以系統(tǒng)論和執(zhí)行控制理論為基礎(chǔ),結(jié)合項目法人制在我國公路建設(shè)項目管理實踐,從公路建設(shè)項目管理和投融資等方面,分析了項目法人制的重要性和推廣項目法人制的必要性。在交通運輸部“《重點公路建設(shè)項目管理規(guī)范》研究”項目的資助下,運用問卷調(diào)查法、座談法、現(xiàn)場走訪等方法對陜西、山西、河北、廣東等省份項目法人制實施情況展開調(diào)查,在總結(jié)研究的基礎(chǔ)上,論述了新時期項目法人制在實踐中仍然存在的問題。(2)結(jié)合公路建設(shè)實踐中項目法人制存在的問題,在調(diào)查、對比和分析研究的基礎(chǔ)上,分傳統(tǒng)、自管、代建三種不同模式的公路建設(shè)項目類型,構(gòu)建了以“法人形式”、“認定程序”、“資格管理”及“目標考核和監(jiān)督”為主要內(nèi)容的項目法人組織機構(gòu)體系。(3)以公路建設(shè)項目執(zhí)行控制理論為基礎(chǔ),以我國公路建設(shè)項目法人制存在的問題為導向,提出了公路建設(shè)項目法人執(zhí)行力的概念。在建立的組織機構(gòu)體系的前提下,建立了基于執(zhí)行控制理論的項目法人執(zhí)行力評價模型,評價項目法人執(zhí)行力,為緩解我國公路建設(shè)項目法人制存在的問題,推進項目法人制提供參考。并結(jié)合公路建設(shè)項目實踐,給出了公路建設(shè)項目法人執(zhí)行力評價的方法和步驟。本文以系統(tǒng)論和執(zhí)行控制理論為基礎(chǔ),結(jié)合政府投資型公路建設(shè)項目法人管理實踐,在我國公路建設(shè)新時期、新任務(wù)的背景下,以問題為導向,進行項目法人組織機構(gòu)研究,豐富和完善項目法人管理理論,推進項目法人制科學實施,促進公路建設(shè)項目管理的規(guī)范化、標準化、精細化進程,為緩解目前公路建設(shè)時間中存在的問題及提高項目法人組織管理能力和執(zhí)行力提供參考。
[Abstract]:Implementing the project legal person system with relatively unified responsibility and rights, promoting the process of fine, standardized, standardized and informational highway construction in our country, providing an inexhaustible motive force for the realization of the leap-forward development goal of our country's highway construction. In the practice of highway construction in China, there is still a lack of clarity in the concept of legal person in the project, and the identification procedure is not standard enough. The qualification management is not clear enough and the examination and supervision system is not perfect. This paper takes the legal person organization of the government investment highway construction project as the research object. This paper discusses the background and significance of the research on the organization of the project legal person, based on the system theory and executive control theory, and combines the project legal person system in the practice of highway construction project management in China. From the aspects of highway construction project management and investment and financing, this paper analyzes the importance of the project legal person system and the necessity of popularizing the project legal person system. By using the methods of questionnaire, discussion and field visit, the author investigates the implementation of the project legal person system in Shaanxi, Shanxi, Hebei, Guangdong and other provinces. On the basis of summarizing the research, This paper discusses the problems that still exist in the practice of the project legal person system in the new period. Combining with the problems existing in the project legal person system in the highway construction practice, on the basis of investigation, comparison and analysis, the author points out the tradition and self-management. Three different types of highway construction projects, Based on the theory of highway construction project execution control, a project legal person organization system with the main contents of "legal person form", "cognizance procedure", "qualification management" and "objective examination and supervision" is constructed. Guided by the problems existing in the legal person system of highway construction projects in China, this paper puts forward the concept of the legal person's executive power of highway construction projects. The evaluation model of project juridical person's execution ability based on execution control theory is established to evaluate the project legal person's execution ability in order to alleviate the problems existing in the legal person system of highway construction project in our country. In this paper, the methods and steps of evaluating the execution ability of legal persons in highway construction projects are given. The system theory and execution control theory are the basis of this paper. Combining with the practice of legal person management of highway construction project with government investment, under the background of the new period and new task of highway construction in our country, the research on the organization of project legal person is carried out in order to enrich and perfect the theory of project legal person management. To promote the scientific implementation of the project legal person system, to promote the standardization, standardization and refinement of highway construction project management, and to provide a reference for alleviating the existing problems in the road construction time and improving the management ability and execution ability of the project legal person organization.
