【摘要】：遷徙自由權(quán)是公民的一項(xiàng)基本人權(quán),世界上大多數(shù)國(guó)家的《憲法》都對(duì)其進(jìn)行了規(guī)定,《世界人權(quán)宣言》和《公民權(quán)利與政治權(quán)利國(guó)際公約》也確認(rèn)了公民的這一權(quán)利。出于政治、經(jīng)濟(jì)等方面的考慮,我國(guó)現(xiàn)行《憲法》并沒有規(guī)定公民的遷徙自由權(quán)。但是在全球經(jīng)濟(jì)一體化、經(jīng)濟(jì)迅速發(fā)展的時(shí)代,在我國(guó)確認(rèn)公民的遷徙自由權(quán)是十分必要的。為了對(duì)我國(guó)公民遷徙自由權(quán)的保障和實(shí)現(xiàn)進(jìn)行研究,構(gòu)建我國(guó)公民的遷徙自由權(quán)制度,首先應(yīng)從權(quán)利、自由、遷徙三個(gè)方面對(duì)遷徙自由權(quán)進(jìn)行法理解說(shuō),并側(cè)重遷徙自由權(quán)的性質(zhì)和獨(dú)特性。進(jìn)而在介紹公民遷徙自由權(quán)歷史演變的基礎(chǔ)上,通過(guò)分析公民遷徙自由權(quán)的域外和域內(nèi)發(fā)展變遷,為研究我國(guó)公民遷徙自由權(quán)的保障和實(shí)現(xiàn)提供借鑒和現(xiàn)實(shí)基礎(chǔ)。基于此,以點(diǎn)及面結(jié)合實(shí)際情況及最新法律規(guī)定從戶籍、教育、社會(huì)保障制度三個(gè)方面分析我國(guó)遷徙自由權(quán)的現(xiàn)狀,根據(jù)現(xiàn)狀從立法、理念、制度三個(gè)方面總結(jié)遷徙自由權(quán)存在的障礙。認(rèn)為保障和實(shí)現(xiàn)我國(guó)公民的遷徙自由權(quán)應(yīng)以一種理性的思維來(lái)看待該權(quán)利,逐步放開遷徙自由權(quán),將公民的遷徙自由權(quán)寫入憲法并規(guī)定相關(guān)救濟(jì)措施,同時(shí)應(yīng)對(duì)相關(guān)制度進(jìn)行改革,只有戶籍、教育、社會(huì)保障、土地、財(cái)政等制度全面推進(jìn)、完善,才能使我國(guó)公民遷徙自由權(quán)得到切實(shí)保障和實(shí)現(xiàn)。
[Abstract]:The right to freedom of movement is a basic human right of citizens, which is stipulated in the Constitution of most countries in the world. The Universal Declaration of Human Rights and the International Covenant on Civil and political Rights also affirm this right of citizens. Due to political and economic considerations, the present Constitution of China does not provide for citizens' right to freedom of movement. However, in the era of global economic integration and rapid economic development, it is necessary to affirm citizens' right to freedom of movement in our country. In order to study the protection and realization of the right to freedom of movement of Chinese citizens and to construct the system of the right to freedom of movement of our country, we should first explain the right of freedom of movement from three aspects: right, freedom and migration. And focus on the nature and uniqueness of the right to freedom of movement. On the basis of introducing the historical evolution of citizen's right to freedom of movement, this paper provides a reference and practical basis for the study of the protection and realization of the right to freedom of movement of citizens in China by analyzing the development and changes of the right of freedom of movement outside the territory and within the region. Based on this, this paper analyzes the status quo of the right to freedom of movement in our country from three aspects of household registration, education and social security system, according to the actual situation and the latest legal provisions. According to the present situation, the author analyzes the status quo of the right to freedom of movement in China. Three aspects of the system summed up the obstacles to the right to freedom of movement. It is believed that the protection and realization of the right to freedom of movement of Chinese citizens should be viewed with a rational thinking, gradually liberalize the right to freedom of movement, write the right of freedom of movement of citizens into the Constitution and stipulate relevant relief measures. At the same time, the relevant system should be reformed, only the system of household registration, education, social security, land, finance and so on can be fully promoted and perfected in order to ensure and realize the right to freedom of movement of Chinese citizens.
