【摘要】：根據(jù)國內(nèi)現(xiàn)行法律規(guī)定,民族自治地方享有在特定事項上的立法權(quán)。以黔東南州現(xiàn)有法律法規(guī)為例,這些規(guī)范在類型上涵蓋授權(quán)性、義務(wù)性和禁止性三種,內(nèi)容上體現(xiàn)了當(dāng)?shù)孛褡逶谡巍⒔?jīng)濟和文化上的特色。這些民族自治地方的規(guī)范雖然在回應(yīng)地方要求以及發(fā)展少數(shù)民族文化上有所建樹,但不可避免的存在一些問題,如與地方法規(guī)的關(guān)系不明以及民間規(guī)范上升為法律法規(guī)的途徑有所缺失。
[Abstract]:According to the current domestic laws, national autonomous areas enjoy legislative power in specific matters. Taking the existing laws and regulations of Qiandongnan Prefecture as an example, these norms cover three types: authorization, obligation and prohibition, which embody the political, economic and cultural characteristics of the local people. Although the norms of these autonomous areas have made some achievements in responding to local demands and developing the culture of ethnic minorities, there are inevitably some problems. If the relationship with local laws and regulations is unclear and folk norms become laws and regulations, there is a lack of ways.
