【摘要】：習(xí)慣法是中華法系重要的組成部分,少數(shù)民族習(xí)慣法是中國(guó)習(xí)慣法體系中內(nèi)容最豐富、影響最大的一種習(xí)慣法,它對(duì)當(dāng)今的少數(shù)民族地區(qū)仍有重大影響,在我國(guó)法治現(xiàn)代化建設(shè)過(guò)程中,習(xí)慣法的影響不容忽視。這個(gè)問(wèn)題由此也成為學(xué)術(shù)界的研究熱點(diǎn),法理學(xué)、法律史學(xué)、社會(huì)學(xué)、人類(lèi)學(xué)、民族學(xué)等領(lǐng)域的學(xué)者都有相關(guān)的研究成果。本文重點(diǎn)分析清代國(guó)家法對(duì)黔東南少數(shù)民族習(xí)慣法的影響,在時(shí)間上限定在清代、在空間上限定為黔東南少數(shù)民族地區(qū),通過(guò)分析清代國(guó)家法在黔東南少數(shù)民族地區(qū)的引入和適用、黔東南少數(shù)民族地區(qū)百姓對(duì)國(guó)家法的自主選擇,總結(jié)出國(guó)家法影響黔東南少數(shù)民族習(xí)慣法的兩種途徑。再通過(guò)比較清代國(guó)家法引入黔東南少數(shù)民族地區(qū)前后少數(shù)民族習(xí)慣法的變化,總結(jié)出清代黔東南少數(shù)民族習(xí)慣法在國(guó)家法影響下的變化。正文包括清代國(guó)家法在黔東南少數(shù)民族地區(qū)的實(shí)施、清代國(guó)家法影響黔東南少數(shù)民族習(xí)慣法的途徑、清代國(guó)家法影響黔東南少數(shù)民族習(xí)慣法的表現(xiàn)三個(gè)部分,共四萬(wàn)多字。清代國(guó)家法在黔東南少數(shù)民族地區(qū)的實(shí)施主要論述了清代國(guó)家法在黔東南少數(shù)民族地區(qū)的引入和施行。首先對(duì)清代黔東南少數(shù)民族地區(qū)的政治、經(jīng)濟(jì)、文化背景進(jìn)行回溯;其次從靜態(tài)的層面從行政制度、刑事制度、民事制度、司法制度四個(gè)方面描述了清代引入黔東南少數(shù)民族地區(qū)的國(guó)家法;再次,從動(dòng)態(tài)的層面描述清代國(guó)家法在黔東南少數(shù)民族地區(qū)的實(shí)際施行狀態(tài)。清代國(guó)家法影響黔東南少數(shù)民族習(xí)慣法的途徑包括在中央主導(dǎo)下的被動(dòng)接受、黔東南少數(shù)民族地區(qū)百姓的自主改變兩個(gè)部分,一種是中央王朝主導(dǎo)下的改變,這是被動(dòng)的接受;一種是黔東南少數(shù)民族百姓自主的改變,這是主動(dòng)的適應(yīng)。兩種方法共同構(gòu)成了清代國(guó)家法影響黔東南少數(shù)民族習(xí)慣法的主要途徑。清代國(guó)家法影響黔東南少數(shù)民族習(xí)慣法的表現(xiàn)是分析清代國(guó)家法影響黔東南少數(shù)民族習(xí)慣法的表現(xiàn),分別從法律表現(xiàn)形式、刑事法律、民事法律、糾紛解決機(jī)制、基層社會(huì)組織法五個(gè)方面進(jìn)行論述。
[Abstract]:The customary law is an important part of the Chinese legal system, and the customary law of ethnic minorities is the most abundant and influential customary law in the Chinese customary law system. In the process of modernization of rule of law in China, the influence of customary law can not be ignored. This problem has also become a hot topic in academic circles. Scholars in jurisprudence, legal history, sociology, anthropology, ethnology and other fields all have related research results. This paper focuses on the analysis of the influence of the state law of the Qing Dynasty on the customary law of the ethnic minorities in the southeast of Guizhou. The time limit is limited to the Qing Dynasty, and the upper limit of space is defined as the minority area in the southeast of Guizhou. Based on the analysis of the introduction and application of the state law in the minority areas of the southeast of Guizhou, the independent choice of the national law in the minority areas of the southeast of Guizhou was analyzed, and two ways of influencing the customary law of the minority nationalities in the southeast of Guizhou were summarized. By comparing the changes of minority customary law before and after the introduction of the State Law in the Qing Dynasty, this paper summarizes the changes of the customary Law of the ethnic minorities in the Southeast of Guizhou under the influence of the State Law in the Qing Dynasty. The text includes the implementation of the state law of Qing Dynasty in the minority areas of southeast Guizhou, the ways that the state law of the Qing Dynasty affects the customary law of the ethnic minorities in the southeast of Guizhou, and the performance of the state law of the Qing Dynasty affecting the customary law of the minority nationalities in the southeast of Guizhou, with a total of more than 40,000 words. The implementation of the state law in the minority areas of southeast Guizhou mainly discusses the introduction and implementation of the state law in the minority areas in the southeast of Guizhou. First of all, the political, economic and cultural background of the ethnic minority areas in the southeast of Guizhou was traced back to the Qing Dynasty; secondly, from the static level, the administrative system, the criminal system, the civil system, Four aspects of the judicial system described the introduction of the Qing Dynasty into the southeast of Guizhou minority areas of the state law; again, from the dynamic level described the state of the Qing Dynasty in the actual implementation of the national law in the southeast of Guizhou minority areas. The influence of the state law of Qing Dynasty on the customary law of ethnic minorities in the southeast of Guizhou includes passive acceptance under the guidance of the central government, and the independent change of the people in the minority areas of the southeast of Guizhou, one is the change under the leadership of the central dynasty, which is the passive acceptance; One is the autonomous change of the minority people in the southeast of Guizhou, which is an active adaptation. The two methods together constitute the main ways of influencing the customary law of ethnic minorities in the southeast of Guizhou by the state law of the Qing Dynasty. The manifestation of the influence of the state law of Qing Dynasty on the customary law of ethnic minorities in the southeast of Guizhou is to analyze the expression of the state law of the Qing Dynasty affecting the customary law of the ethnic minorities in the southeast of Guizhou, respectively from the legal manifestation, the criminal law, the civil law, the dispute resolution mechanism.
