【摘要】：儒家經(jīng)典《禮記》中記載到:"大道之行也,天下為公,選賢與能,講信修睦。故人不獨親其親,不獨子其子,使老有所終,壯有所用,幼有所長,鰥、寡、孤、獨、廢疾者皆有所養(yǎng)"。這句耳熟能詳?shù)脑娋渌愕蒙鲜俏覈钤缬涗浬鐣Ｕ虾宛B(yǎng)老思想的論述了,可見古人對于養(yǎng)老制度的構(gòu)建是充滿智慧和期待的。從古至今,我國歷來重視民生福祉。黨的十八大明確要求:各級黨委和政府應(yīng)該不斷加強社會建設(shè),著力保障和改善民生,不斷創(chuàng)新社會管理方式,這樣才能保證社會的和諧穩(wěn)定。保障和改善民生是一項十分重要的基礎(chǔ)性工程,在這個過程中,應(yīng)該充分了解廣大人民群眾的疾苦和需求,解決廣大人民群眾最關(guān)心和最直接的現(xiàn)實問題,讓廣大人民群眾享受到改革和發(fā)展帶來的成果。老有所養(yǎng)是每一個人的最好的歸宿和愿望,也是政府責(zé)任和社會責(zé)任的重要體現(xiàn)。從整體上來看,我國是一個農(nóng)業(yè)大國,農(nóng)民的整體數(shù)量很多。改革開放以來,特別是近年來,隨著城市化進程的不斷加快,很多的農(nóng)村勞動力為了獲得更好的就業(yè)機會紛紛來到城市打工,留守老人和兒童不斷增加,這就使得土地養(yǎng)老的功能大大降低。此外,隨著農(nóng)村老年人數(shù)量的不斷增加,農(nóng)村養(yǎng)老成為了一個迫切需要解決的現(xiàn)實問題。由于歷史和現(xiàn)實的因素,我國的社會養(yǎng)老保險制度并沒有涵蓋廣大的農(nóng)民,這樣不僅造成了城鄉(xiāng)發(fā)展不平衡,也沒有充分體現(xiàn)出我國改革開放的紅利惠及廣大的農(nóng)民。因此,筆者認為我國應(yīng)該建立完善的農(nóng)村社會養(yǎng)老保險法律制度,頒布更多相關(guān)的法律法規(guī),并在此基礎(chǔ)上提出了完善相關(guān)法律體系的建議。本文結(jié)構(gòu)共分為四個部分:在第一部分中,筆者重點對養(yǎng)老保險的定義和特點進行了闡述,對我國農(nóng)村養(yǎng)老保險制度進行了介紹,從政治學(xué)、經(jīng)濟學(xué)、法學(xué)角度對養(yǎng)老保險制度的相關(guān)理論進行了闡述,其目的就是對我國農(nóng)村養(yǎng)老保險制度有一個整體的了解。筆者在第二部分中對農(nóng)村養(yǎng)老保險法律體系進行了介紹,深刻揭示了法律制度在立法和執(zhí)法過程中產(chǎn)生的問題,從多個角度對產(chǎn)生這些問題的原因進行了重點的闡述和分析。筆者在第三部分中對國外的三種十分具有代表性的農(nóng)村養(yǎng)老保險法律制度模式進行了介紹,結(jié)合我國的實際情況對國外先進的經(jīng)驗和做法進行總結(jié)。筆者在第四部分中,重點對如何完善我國農(nóng)村養(yǎng)老保險法律制度進行了論述,不僅從立法和執(zhí)法角度進行了詳細的分析,同時還從制度健全等方面提出了一些十分具有建設(shè)性的完善農(nóng)村養(yǎng)老保險法律制度的建議和措施。
[Abstract]:The Confucian Classical Book of Rites records: "when Great Way was carried out, the world was common to all." Old people not only kiss their relatives, not only their son, so that the old have a final, strong and useful, young have a director, widowed, lonely, alone, the sick have to support. This familiar poem is the earliest record of social security and old-age thoughts in China, it shows that the ancients were full of wisdom and expectation for the construction of the old-age system. Since ancient times, our country has always attached importance to the well-being of the people's livelihood. The party committee and government at all levels should constantly strengthen social construction, strive to ensure and improve the people's livelihood, and constantly innovate the way of social management in order to ensure social harmony and stability. Safeguarding and improving people's livelihood is a very important basic project. In this process, we should fully understand the sufferings and needs of the broad masses of the people, and solve the most concerned and immediate practical problems of the broad masses of the people. Let the masses enjoy the fruits of reform and development. The sense of security is everyone's best home and wish, and also the important embodiment of government responsibility and social responsibility. Overall, China is a large agricultural country, the overall number of farmers a lot. Since the reform and opening up, especially in recent years, with the continuous acceleration of the urbanization process, many rural labor forces have come to the city to work in order to obtain better employment opportunities, and the number of left-behind old people and children has been increasing. This makes the function of land endowment greatly reduced. In addition, with the increasing number of rural elderly, rural old-age care has become an urgent need to solve the reality of the problem. Because of the historical and realistic factors, the social old-age insurance system of our country does not cover the vast number of farmers, which not only causes the imbalance of urban and rural development, but also does not fully reflect the dividend of reform and opening to the outside world to benefit the majority of farmers. Therefore, the author thinks that our country should establish the perfect legal system of rural social endowment insurance, promulgate more relevant laws and regulations, and put forward the suggestion of perfecting the relevant legal system on this basis. The structure of this paper is divided into four parts: in the first part, the author focuses on the definition and characteristics of the old-age insurance, and introduces the rural old-age insurance system in China, from political science, economics, The related theory of endowment insurance system is expounded from the angle of law, and its purpose is to have an overall understanding of the rural endowment insurance system in our country. In the second part, the author introduces the legal system of rural old-age insurance, deeply reveals the problems in the process of legislation and enforcement of the law system, and expounds and analyzes the causes of these problems from many angles. In the third part, the author introduces three kinds of representative rural old-age insurance legal system models abroad, and summarizes the advanced experience and practice of foreign countries according to the actual situation of our country. In the fourth part, the author focuses on how to improve the legal system of rural old-age insurance in China, not only from the perspective of legislation and law enforcement for a detailed analysis. At the same time, some constructive suggestions and measures are put forward to perfect the legal system of rural old-age insurance.
