【摘要】:國(guó)土資源部日前針對(duì)少數(shù)提前到期住宅用地使用權(quán)的續(xù)期問(wèn)題,以復(fù)函的方式公開(kāi)發(fā)布了“兩不一正!钡倪^(guò)渡性辦法,這對(duì)70年住宅建設(shè)用地到期后自動(dòng)續(xù)期的法律安排的走向,給予社會(huì)大眾以強(qiáng)烈的心理暗示!段餀(quán)法》149條對(duì)自動(dòng)續(xù)期的規(guī)定,屬“將來(lái)時(shí)”,而非“現(xiàn)在時(shí)”。當(dāng)前少數(shù)住宅建設(shè)用地使用權(quán)到期后的續(xù)期問(wèn)題,是現(xiàn)行國(guó)有土地出讓制度框架下合同法范疇的續(xù)期問(wèn)題,是一個(gè)依法行政的問(wèn)題,將短于法定最高年限的土地使用權(quán)期間,依現(xiàn)行法律法規(guī)將其補(bǔ)足至最高年限,當(dāng)屬不二選擇。而70年住宅建設(shè)用地使用權(quán)期間屆滿后的自動(dòng)續(xù)期,則是一個(gè)打破甚至顛覆現(xiàn)行國(guó)有土地出讓制度框架的重大改革問(wèn)題,事關(guān)人民與國(guó)有土地的權(quán)利義務(wù)關(guān)系的再造,涉及我國(guó)土地財(cái)產(chǎn)權(quán)制度未來(lái)改革發(fā)展的大方向,對(duì)自動(dòng)續(xù)期的法律方案的探索和設(shè)計(jì)必須慎之又慎,切忌在其政治、經(jīng)濟(jì)和社會(huì)條件尚不具備時(shí)草率作出安排。
[Abstract]:The Ministry of Land and Resources, in response to the issue of the renewal of a small number of residential land use rights that have expired in advance, publicly issued a transitional method of "two different normal" in the form of a reply. This is the trend of the legal arrangements for the automatic renewal of residential land after the expiration of 70 years, which gives the public a strong psychological hint. Article 149 of the Law of Real Rights stipulates that the automatic renewal of residential land is a "future tense" rather than a "present tense". At present, the renewal of the right to use residential construction land after its expiration is a question of renewal of the scope of contract law within the framework of the current system of transfer of state-owned land, and a matter of administration according to law, which will be shorter than the period of land use right with the maximum legal term. According to the existing laws and regulations to complement the maximum number of years, should be a choice. The automatic renewal of the right to use residential construction land after the expiration of the period of 70 years is a major reform problem that breaks or even subverts the current system of the transfer of state-owned land, which is related to the re-creation of the relationship between the rights and obligations of the people and the state-owned land. Concerning the general direction of the future reform and development of the land property right system in our country, the exploration and design of the legal scheme of automatic renewal must be taken care of, and the hasty arrangement should not be made when the political, economic and social conditions are not available.
