【摘要】：《地方政府組織法》自制定生效以來,已經(jīng)過5次修改。然而,其仍有明顯的時代滯后性。從宏觀上講,其與我國當(dāng)今政治、經(jīng)濟(jì)、文化等格局發(fā)生了深刻變化的大背景不太吻合;就立法本身而言,其沒有確立地方政府的法律人格,沒有區(qū)分地方政府與中央政府的職能,沒有嚴(yán)格設(shè)置地方政府的層級職能,沒有對地方政府機(jī)構(gòu)作出剛性規(guī)定等。地方政府組織法的修改必須建立在一定的法治觀念的基礎(chǔ)上,不能草率修改。沒有相應(yīng)的法治觀念指導(dǎo),該法的修改必然會走入修改頻繁,修改后回到原有缺陷的怪圈之中。在相關(guān)法治觀念的指導(dǎo)下,下列范疇?wèi)?yīng)予以完善:地方政府組織及地方政府組織法稱謂,地方政府組織與中央政府關(guān)系的表述,地方政府職權(quán)行文方式,地方政府組織連結(jié)關(guān)系等。
[Abstract]:The Local Government Organization Act has been amended five times since it came into effect. However, it still has obvious time lag. From the macro point of view, it does not coincide with the background of the profound changes in the political, economic, cultural and other patterns of our country; as far as the legislation itself is concerned, it does not establish the legal personality of the local government. There is no distinction between the functions of local government and central government, there is no strict establishment of hierarchical functions of local government, and there are no rigid regulations on local government institutions. The amendment of the local government organization law must be based on a certain concept of rule of law, not be amended hastily. Without the guidance of the concept of the rule of law, the amendment of the law will inevitably go into the strange circle of the original defects. Under the guidance of relevant concepts of the rule of law, the following areas should be perfected: the title of local government organizations and local government organizations, the expression of the relationship between local government organizations and the central government, the way in which local government functions and powers are written, Local government organizations linked to relationships, etc.
