【摘要】：國(guó)內(nèi)石油企業(yè)的壟斷是諸多能源行業(yè)壟斷的一種,中國(guó)石油、中石化、中國(guó)海洋石油三大國(guó)企基本上壟斷了石油(包括天然氣)上游開采、油氣進(jìn)口、中游煉化、下游銷售等各個(gè)環(huán)節(jié)。由于壟斷帶來的社會(huì)資源配置不合理,相比之下員工福利超出社會(huì)平均水平太多,損害了消費(fèi)者的利益。同時(shí),對(duì)環(huán)境和資源帶來的危害,國(guó)家來負(fù)責(zé)。油氣價(jià)格出現(xiàn)漲價(jià)幅度大,漲價(jià)頻率高,降價(jià)幅度小,降價(jià)頻率低的特點(diǎn)。正因如此,壟斷行業(yè)中的這些弊端造成的民眾對(duì)于需要承擔(dān)無選擇權(quán)、高等價(jià)格、劣等服務(wù)的不滿情緒與日俱增。面臨高漲不下國(guó)際原油價(jià)格,國(guó)內(nèi)原油產(chǎn)量和含量日益減少的局勢(shì)下,通過改革國(guó)內(nèi)石油企業(yè)的壟斷,跳出行政制約,充分引入競(jìng)爭(zhēng)這一有效機(jī)制,讓市場(chǎng)在資源配置中發(fā)揮主導(dǎo)作用,才能更好的調(diào)動(dòng)石油企業(yè)的活力。 中國(guó)石油企業(yè)的壟斷由來已久,解決石油企業(yè)的壟斷問題,要以馬克思主義的壟斷的理論、經(jīng)濟(jì)利益理論和市場(chǎng)競(jìng)爭(zhēng)理論為基礎(chǔ)。因此,文章首先梳理馬克思主義的壟斷的理論、利益理論和市場(chǎng)競(jìng)爭(zhēng)理論；其次分析國(guó)內(nèi)石油企業(yè)壟斷的現(xiàn)狀、壟斷的表現(xiàn)、壟斷的原因和危害；最后,借鑒國(guó)際反壟斷的經(jīng)驗(yàn),從政治、經(jīng)濟(jì)、法律法規(guī)等視角,提出解決石油企業(yè)壟斷的對(duì)策,并對(duì)這些對(duì)策的可行性進(jìn)行分析,以有效改善石油企業(yè)壟斷的問題,創(chuàng)造一個(gè)公平的競(jìng)爭(zhēng)環(huán)境。
[Abstract]:The monopoly of domestic oil enterprises is one of the monopolies in many energy industries. The three major state-owned enterprises, namely, PetroChina, Sinopec, and CNOOC, basically monopolize the upstream exploitation of oil (including natural gas), the import of oil and gas, and the refining of the middle reaches. Because of the unreasonable allocation of social resources brought about by monopoly, in contrast, the welfare of employees exceeds the average level of society, which damages the interests of consumers. At the same time, it brings harm to the environment and resources. The state is in charge. Oil and gas prices have the characteristics of large price increases, high price increases, small price cuts, and low price reductions. Precisely because of this, the people in monopoly industries have no right of choice to bear the right to choose, higher prices. Dissatisfaction with inferior services is growing day by day. Faced with the situation of rising international crude oil prices and decreasing domestic crude oil production and content, by reforming the monopoly of domestic oil enterprises and jumping out of administrative constraints, Only by fully introducing the effective mechanism of competition and allowing the market to play a leading role in the allocation of resources can we better mobilize the vitality of oil enterprises. The monopoly of Chinese petroleum enterprises has a long history. To solve the monopoly problem of petroleum enterprises, we should base on the theory of Marxist monopoly, the theory of economic interests and the theory of market competition. The article first combs the Marxist monopoly theory, the benefit theory and the market competition theory; secondly, analyzes the domestic petroleum enterprise monopoly present situation, the monopoly performance, the monopoly reason and the harm; finally, draws lessons from the international antitrust experience, From the perspectives of politics, economy, laws and regulations, this paper puts forward the countermeasures to solve the monopoly of petroleum enterprises, and analyzes the feasibility of these countermeasures in order to effectively improve the monopoly of oil enterprises and create a fair competition environment.
