【摘要】：發(fā)展權(quán)概念的核心在于發(fā)展機(jī)會(huì)的均等,強(qiáng)調(diào)不同地區(qū)的當(dāng)代和后代主體之間在政治、經(jīng)濟(jì)、社會(huì)和文化領(lǐng)域的平等發(fā)展機(jī)會(huì),發(fā)展權(quán)的保障有賴于符合公平正義訴求的經(jīng)濟(jì)及社會(huì)發(fā)展政策。無論從理論發(fā)展的需要而言,還是從調(diào)節(jié)社會(huì)矛盾的現(xiàn)實(shí)需求出發(fā),都應(yīng)進(jìn)行促進(jìn)發(fā)展權(quán)保障的公共政策路徑研究。本文認(rèn)為公共政策應(yīng)當(dāng)在出發(fā)點(diǎn)、根本價(jià)值取向和優(yōu)先性等關(guān)鍵環(huán)節(jié)貫穿人的平等發(fā)展訴求,促進(jìn)社會(huì)公平正義的實(shí)現(xiàn)。應(yīng)當(dāng)使公民擁有公共政策程序的有序參與機(jī)會(huì),通過公平的分配政策平等享有物質(zhì)財(cái)富與社會(huì)資源,并依托優(yōu)先保護(hù)資源環(huán)境的政策,使當(dāng)代人與后代人都能夠享有優(yōu)質(zhì)的自然環(huán)境。本文提出符合程序公正、結(jié)果公平、環(huán)保優(yōu)先和代際正義要求的路徑選擇思路,可為公共政策的制定、調(diào)整和優(yōu)化提供參考。
[Abstract]:At the heart of the concept of the right to development lies in the equality of opportunities for development, emphasizing equal opportunities for development in the political, economic, social and cultural fields between contemporary and future generations in different regions, The guarantee of the right to development depends on economic and social development policies that meet the demands of equity and justice. This paper holds that public policy should be based on the starting point, the basic value orientation and the priority, and so on. To promote the realization of social equity and justice... citizens should be given an orderly opportunity to participate in public policy procedures, equal access to material wealth and social resources through equitable distribution policies, and reliance on policies that give priority to the protection of the resource environment, This paper puts forward the path choice thought which accords with the procedure justice, the result fairness, the environmental protection priority and the intergenerational justice request, may provide the reference for the public policy formulation, adjustment and optimization.
