【摘要】：隨著我國工業(yè)化、城市化和社會現(xiàn)代化的快速發(fā)展，對大量的建設(shè)用地有著急切的需求，在土地資源有限性的條件下，建設(shè)用地對部分農(nóng)業(yè)用地和農(nóng)村房屋建設(shè)用地進行擴張是必不可免的。然而在這一擴張過程中，日益顯現(xiàn)出農(nóng)民土地權(quán)益的薄弱、農(nóng)村土地產(chǎn)權(quán)制度的缺陷、地方政府征地行為異化等問題。 征地問題產(chǎn)生的原因是多方面的，有政府的責任，有農(nóng)民的責任，也有制度的漏洞。但地方政府作為征地的主要執(zhí)行者，具有不可推卸的重責任。 本文采用主要文獻研究和案例分析相結(jié)合的方法，分析地方政府在征地過程中出現(xiàn)行為異化主要源于兩方面原因，一是我國農(nóng)村土地產(chǎn)權(quán)制度存在先天性制度缺陷，為地方政府征收或者征用農(nóng)村土地中謀取利益提供了“合法性”空間和利益刺激；二是地方政府“經(jīng)濟人”特性，在違法違規(guī)圈地征地成本較低的情形下，濫用亂用征地權(quán)，獲取高額土地出讓金，建設(shè)政績工程，獲得部門和個人的政治、經(jīng)濟利益。因此，要解決農(nóng)村征地過程中地方政府行為異化問題，要從兩方面著手，一方面要完善我國現(xiàn)行的農(nóng)村土地產(chǎn)權(quán)制度，，以有效保障征收中農(nóng)民的合法權(quán)益；另一方面要進一步推進政治體制改革，轉(zhuǎn)變政府職能，嚴格規(guī)范地方政府行為。
[Abstract]:With the rapid development of industrialization, urbanization and social modernization in our country, there is an urgent need for a large number of construction land, under the condition of limited land resources, It is inevitable for construction land to expand some agricultural land and rural housing construction land. However, in the process of this expansion, the weakness of farmers' land rights and interests and the defects of rural land property right system are increasingly revealed. Local government land expropriation behavior alienation and other issues. There are many reasons for the land expropriation, including the responsibility of the government, the responsibility of the peasants and the loopholes of the system, but the local government, as the main executor of the land requisition, has the unshirkable responsibility. This article uses the method of combining the main literature research and the case analysis to analyze that the behavior alienation of the local government in the process of land expropriation mainly comes from two reasons: the first is the inherent institutional defect of the rural land property right system in our country. It provides "legitimacy" space and interest incentive for local government to expropriate or expropriate rural land, and second, local government "economic man" characteristic, in the case of low cost of illegal land expropriation, misuse of the right to expropriate land, To obtain high land transfer fees, to build projects of political achievements, and to obtain the political and economic interests of departments and individuals, therefore, to solve the problem of alienation of local government behavior in the process of land requisition in rural areas, we must start from two aspects. On the one hand, it is necessary to perfect the current system of rural land property right in our country in order to effectively protect the legitimate rights and interests of peasants in expropriation; on the other hand, we should further promote the reform of political system, transform the functions of the government, and strictly standardize the behavior of local governments.
