【摘要】:目前,我國(guó)正處在深化改革時(shí)期,政治、經(jīng)濟(jì)、社會(huì)各個(gè)方面復(fù)雜性明顯增強(qiáng)。面對(duì)社會(huì)治理存在的諸多風(fēng)險(xiǎn)和挑戰(zhàn),政府的行政改革是社會(huì)各界關(guān)注的焦點(diǎn)。政府需要做的是加強(qiáng)服務(wù)型政府的建設(shè),提高自身的執(zhí)政能力,強(qiáng)化行政責(zé)任的落實(shí)。政府行政組織是一個(gè)由行政人員組成的群體,行政能力的提高必須加強(qiáng)對(duì)行政人員個(gè)體行為的關(guān)注。 由于面臨著復(fù)雜的環(huán)境,作為治理主體的政府承擔(dān)的責(zé)任也相應(yīng)的復(fù)雜化。政府需要回應(yīng)社會(huì)和民眾的基本要求并積極采取行動(dòng)加以滿足;需要接受來(lái)自內(nèi)部的和外部的控制以保證行政責(zé)任的實(shí)現(xiàn)。傳統(tǒng)的行政責(zé)任強(qiáng)調(diào)以控制的措施來(lái)規(guī)范行政人員的行為,行政人員被認(rèn)為是價(jià)值中立的,被動(dòng)的承擔(dān)組織上賦予的責(zé)任。一旦行政人員違反了行政責(zé)任,則會(huì)受到行政上的處分或法律上的追責(zé),行政責(zé)任僅僅在行政(狹義)和法律方面被片面化的實(shí)現(xiàn)。新公共行政的理論發(fā)展使得更多的價(jià)值因素被引入到公共行政中,行政人員不再被中立的定位所束縛,擁有了一定的自由裁量權(quán),,他們的主觀行為具有了更為重要的意義。隨著公民精神和公民參與的增強(qiáng),政府的治理面臨更加復(fù)雜的情形,行政人員要扮演更多的角色,承擔(dān)更多的責(zé)任,不僅承擔(dān)行政上的、法律上的責(zé)任,更包括政治上的、道德上的責(zé)任,只有通過(guò)對(duì)這些行政責(zé)任進(jìn)行重構(gòu)才能確保政府更好的治理社會(huì)。 事實(shí)上,對(duì)行政人員的行為從規(guī)則制度層面進(jìn)行約束是消極的責(zé)任實(shí)現(xiàn)方式,只有當(dāng)行政人員具有主觀的責(zé)任意識(shí),擁有倫理道德的價(jià)值觀念時(shí),才能夠真正確保行政責(zé)任的實(shí)現(xiàn)。因此,確立起倫理道德對(duì)于各種責(zé)任的統(tǒng)帥作用,通過(guò)道德制度的設(shè)立來(lái)規(guī)范行政組織和行政人員的行為,在整體上實(shí)現(xiàn)行政責(zé)任具有根本性的意義。本文關(guān)注和研究行政責(zé)任問(wèn)題,探討實(shí)現(xiàn)行政責(zé)任的路徑和方法,并從制度角度對(duì)行政責(zé)任的實(shí)現(xiàn)進(jìn)行整體建構(gòu),最終行政責(zé)任的實(shí)現(xiàn)將落實(shí)在行政人格的建構(gòu)上。
[Abstract]:At present, our country is in the reform period, the political, economic and social aspects of complexity significantly enhanced. Facing many risks and challenges of social governance exist, the government's administrative reform is the focus of attention of the community. The government needs to do is to strengthen the construction of service-oriented government, improve its ruling ability, strengthen the administrative responsibility the implementation of the government. The administrative organization is composed of a group of administrative personnel, administrative ability must strengthen the administrative personnel behavior of the individual attention.
Faced with the complex environment and complex as the main governance of government responsibility accordingly. The government needs to respond to the basic requirements of society and the people and take active action to meet the need of control; internal and external administrative responsibility to ensure the implementation of the administrative responsibility. The traditional emphasis on control measures the norms of the administrative personnel, administrative personnel is considered neutral, given the organizational commitment on passive responsibility. Once the administrative personnel in violation of administrative responsibility, will be subject to administrative punishment or legal responsibility, administrative responsibility only (Xia Yi) in the administrative and legal aspects are one-sided achieve. The theory of the development of public administration makes more value factors have been introduced to the public administration, administrative personnel are not tied to a neutral position, have some discretion, they The subjective behavior has a more important significance. With the enhancement of the spirit of citizenship and civic participation, government is facing more complicated situation, administrative personnel should play more roles, take more responsibility, not only bear administrative and legal responsibilities, including political, moral responsibility, only through the reconstruction to the administrative responsibility to ensure that the government better governance of society.
In fact, the administrative personnel behavior rules from system level constraints is negative responsibility, only when administrative personnel with subjective sense of responsibility, has the value of ethics, to truly ensure administrative responsibility. Therefore, establish the leading role of ethics on various responsibilities, through the establishment of moral the system to regulate the administrative organization and the administrative personnel's behavior, realize the administrative responsibility as a whole has fundamental significance. This paper pay attention to and study the problem of administrative responsibility, to explore the path and method to realize the administrative responsibility, and from the angle of the system of administrative responsibility for overall construction, the final realization of the administrative responsibility will be implemented in the construction of the personality.
