【摘要】:房屋征收是城市現(xiàn)代化的必然結(jié)果,我國房屋征收制度經(jīng)過了從計劃經(jīng)濟時代到市場經(jīng)濟時期的發(fā)展階段,伴隨著我國政治經(jīng)濟體制的轉(zhuǎn)變逐漸成熟。房屋征收中的利益沖突及法律調(diào)整問題涉及公權(quán)力與私權(quán)利的平衡與協(xié)調(diào),關(guān)乎國計民生。從《城市房屋拆遷管理條例》到《國有土地上房屋征收與補償條例》我們可以發(fā)現(xiàn)房屋征收制度逐漸規(guī)范公權(quán),同時也加強對房屋被征收人的合法權(quán)利的保護。然而,現(xiàn)行條例在實施中依然存在征收難導致的各種各樣的官民糾紛。法律具有滯后性,實踐中的房屋征收活動比法律規(guī)定的情況復雜得多,房屋征收方面的理論成果尚未被法律吸收,因此不能與實踐中的房屋征收活動同步。如現(xiàn)行條例雖規(guī)定了房屋征收是以公共利益為目的的行政征收,但實踐中確有很多征收案例以“公共利益之名”,行“商業(yè)利益之實”,侵犯相對人合法權(quán)益。又如,現(xiàn)行法對相對人的補償中沒有統(tǒng)一規(guī)定“土地使用權(quán)補償”的問題,導致不能保證對相對人公平補償。另外,行政執(zhí)法中也存在大量違法征收行為,如,房屋征收決定和補償決定的作出不符合法律法規(guī)的規(guī)定。此外,征收活動涉及的領(lǐng)域很廣,涉及的一系列制度也需要健全,如房屋評估制度、聽證制度。筆者通過結(jié)合理論界研究的最新成果,對實踐中房屋征收工作存在的問題以及對房屋征收法律制度進行剖析,從實體法和程序法兩方面分別探討,以提出完善現(xiàn)行條例的措施,以便更好的指導和規(guī)范我國的房屋征收工作。本論文分三個部分,第一部分介紹了《國有土地上房屋征收與補償條例》的立法背景以及其產(chǎn)生的積極意義,立法背景了介紹《城市房屋拆遷管理條例》內(nèi)容以及該條例下我國的房屋征收亂象。積極意義從正當程序的確立、補償條款的完善、行政強制拆遷的限制等三個方面進行闡述;第二部分剖析了《國有土地中房屋征收與補償條例》適用中存在的各種立法、執(zhí)法和司法問題,主要從公共利益界定和認定、聽證制度、補償制度、行政違法征收以及司法救濟等多方面論述;第三部分是筆者就《國有土地中房屋與征收補償條例》在適用中存在的問題提出的相關(guān)建議。
[Abstract]:Housing expropriation is the inevitable result of urban modernization. The housing expropriation system of our country has gone through the stage of development from the planned economy era to the market economy period. With the change of our country's political and economic system, the conflicts of interest and the legal adjustment in the housing expropriation involve the balance and coordination between the public power and the private right. Related to the national economy and people's livelihood. From "Urban Housing demolition Administration regulations" to "State-owned Land Housing Collection and compensation regulations" we can find that the housing expropriation system gradually standardized public rights. At the same time, it also strengthens the protection of the legal rights of the house expropriated. However, in the implementation of the existing regulations, there are still various disputes between the government and the people caused by the difficulty of expropriation. The practice of housing expropriation activities than the legal provisions of the situation is much more complex, housing collection theory has not yet been absorbed by the law. Therefore, it can not be synchronized with the practice of housing expropriation activities. For example, although the current regulations stipulate that housing expropriation is administrative expropriation for the purpose of public interest, in practice there are many cases of expropriation in the name of "public interest". For example, there is no uniform stipulation on the compensation of the right to use land in the current law. In addition, there are a large number of illegal expropriation acts in the administrative law enforcement, such as, the decision of house expropriation and compensation decision is not in accordance with the provisions of laws and regulations. Expropriation activities involve a wide range of areas, involving a series of systems also need to be improved, such as housing evaluation system, hearing system. This paper analyzes the problems existing in the practice of house expropriation and the legal system of housing collection, and probes into the two aspects of substantive law and procedural law respectively, in order to put forward the measures to perfect the existing regulations. This paper is divided into three parts. The first part introduces the legislative background and the positive significance of the "Housing expropriation and compensation regulations on State-owned Land". The legislative background introduces the contents of Urban Housing demolition Management regulations and the chaos of housing collection in China under the regulations. The positive significance is from the establishment of due process and the perfection of compensation clauses. The restriction of administrative forced demolition is expounded in three aspects. The second part analyzes the various legislative, law enforcement and judicial problems existing in the application of the regulations on Housing Collection and compensation in State-owned Land, mainly from the public interest definition and recognition, hearing system, compensation system. Administrative illegal collection and judicial relief and other aspects of the discussion; The third part is the author's suggestions on the problems existing in the application of the regulations on compensation for Housing and expropriation in State-owned Land.
