【摘要】：“創(chuàng)設(shè)票據(jù)的原因關(guān)系不會(huì)影響票據(jù)關(guān)系的效力”已經(jīng)成為基本常識(shí),但是票據(jù)關(guān)系對(duì)原因關(guān)系構(gòu)成何種影響?遵從影響原因關(guān)系的法律事實(shí)是票據(jù)授受過(guò)程中出票人與收款人或者背書(shū)人與被背書(shū)人達(dá)成的協(xié)議的理論基礎(chǔ),論文闡述了票據(jù)授受影響原因關(guān)系的具體表現(xiàn)。原則上即使存在票據(jù)的授受,也不因此而使既存的債權(quán)債務(wù)當(dāng)然消滅。原因債權(quán)是否消滅,要看當(dāng)事人授受票據(jù)的目的制約。如果當(dāng)事人意思不明,接受票據(jù)的人應(yīng)該同時(shí)享有兩種權(quán)利,只是通常首先行使票據(jù)上的權(quán)利,在特定情形下也可先行使原因債權(quán),只是需要返還票據(jù)。如果票據(jù)喪失,債務(wù)人可以主張用除權(quán)判決作為交換條件而支付的抗辯。出現(xiàn)票據(jù)債權(quán)因時(shí)效消滅的情形時(shí),如果債權(quán)人不能舉證,就必須出示票據(jù)。
[Abstract]:The paper expounds the relation between the reason and the reason of the bill . If the party ' s meaning is not clear , the person who accepts the bill should enjoy two rights at the same time . If the party doesn ' t know , the debtor can claim two kinds of rights . If the bill is lost , the debtor can argue that the creditor ' s right is to be paid as the exchange condition . If the creditor cannot prove it , it must produce the bill .
