【摘要】：公益信托的發(fā)展已有近400年的歷史，在社會公益事業(yè)的發(fā)展中有著舉足輕重的地位。公益信托最早起源于英國，并在英美法系國家迅速發(fā)展并逐步趨向于完善，他不僅對推動其他國家公益信托事業(yè)的發(fā)展起著十分重要的作用，而且對世界慈善事業(yè)的發(fā)展做出了巨大貢獻。公益信托制度傳入我國的時間并不長，但在我國公益事業(yè)的發(fā)展中占據(jù)著重要位置，為我國慈善事業(yè)的發(fā)展提供了正確的指引。我國自《信托法》制定完成后，信托業(yè)有了較快的發(fā)展，公益信托制度從此有了法律的保障。隨著更多的人們投身于公益事業(yè)，，捐贈財產(chǎn)數(shù)額不斷的增加，這就使更多需要幫助的人們從中受益。公益信托作為一種重要的對財產(chǎn)進行管理的制度，是現(xiàn)代社會公益事業(yè)發(fā)展進步的重要支持，其最突出的優(yōu)點就是它可以代為處理社會公眾捐贈的財產(chǎn)，保障社會公眾捐贈的財產(chǎn)得到妥善的處理，維護社會公共利益。我國的公益信托制度是在吸取外國先進經(jīng)驗的基礎(chǔ)上發(fā)展并成熟的，符合我國當(dāng)前的國情和社會發(fā)展的實際，具有積極意義。但是，如果要使公益信托制度在我國快速和健康的發(fā)展，使公益信托制度充分發(fā)揮其作用，以及促使其目的和作用的實現(xiàn)，就必須盡快建立完善公益信托監(jiān)管法律制度保障公益信托的有效運行。 我國《信托法》對公益信托制度作出了具體的規(guī)定，同時也對公益信托監(jiān)管制度也進行了規(guī)定。但是，由于法律對公益信托監(jiān)管的規(guī)定不夠細(xì)致，公益信托在我國的發(fā)展時間也不長，各項配套措施不健全，加上人們對公益信托的認(rèn)識不深，以致在解決實際問題上遇到了諸多困難。因此，本文在對公益信托制度進行必要梳理研究的基礎(chǔ)上，對我國公益信托監(jiān)管的法律現(xiàn)狀和運行現(xiàn)狀加以分析，發(fā)現(xiàn)我國公益信托監(jiān)管中存在的問題，并在此基礎(chǔ)上借鑒英美法系和大陸法系國家或地區(qū)有關(guān)公益信托監(jiān)管的經(jīng)驗，從而提出如何構(gòu)建我國公益信托的法律監(jiān)管制度。
[Abstract]:The development of public trust has been nearly 400 years of history, has a pivotal position in the development of social welfare. The public trust originated in the United Kingdom, and in common law countries is developing rapidly and gradually tends to improve, he not only to promote the development of other national public trust industry plays a very important role. And made a great contribution to the development of the world. The charity charitable trust system into China is not a long time, but occupies an important position in the development of China's public welfare, provide correct guidance for the development of China's philanthropy. Since China's "trust law" after the completion of the development, the trust industry the rapid development of charitable trust system has the legal protection. With more and more people participate in public welfare undertakings, the donation amount is increasing, which makes more people who need help from the public benefit. Benefit trust as an important system of management of the property, is an important support for the modern development of social welfare and progress, the most prominent advantages is that it can handle the public donated property, protection of property donated by the public properly, maintain the social public interests. Our system of charitable trust is based on absorbing foreign advanced experience on the development and mature, consistent with the actual condition of our country and social development, has positive significance. However, if the system of public trust in the development of China's rapid and healthy, so that the public trust system to fully play its role, and to realize the purpose and function of the then, we must establish and perfect the charitable trust supervision system to ensure the effective operation of public trust as soon as possible.
Our "Trust Law > made specific provisions on the system of charitable trust, but also to the public trust supervision system has also been specified. However, due to legal provisions on the supervision of public trust is not detailed enough, the public trust in China's development time is not long, the supporting measures are not perfect, and the public awareness of the trust is not deep, they encountered many difficulties in solving practical problems. Therefore, based on the summary of the system of public trust, the legal status and status quo of public trust supervision in China are analyzed, found the supervision of charitable trust in our country, and on the basis of experience the supervision of public trust in common law and civil law countries or regions, and then puts forward how to construct the legal supervision system of China's public trust.
