【摘要】：票據(jù)的無因性也稱為抽象性,與民法中的無因性相比,票據(jù)無因性有著自身的特點(diǎn),表現(xiàn)在內(nèi)涵和外延兩個(gè)方面。票據(jù)的理論在發(fā)展中總的來說可以分為一元論和二元論,在一元論中主要是交付契約論、發(fā)行說、創(chuàng)造說,而作為彌補(bǔ)一元論理論缺陷的權(quán)利外觀說并非一種獨(dú)立的票據(jù)理論,更多的是一種輔助的手段。二元論則是指票據(jù)行為二階段理論,一元論和二元論兩者的區(qū)別在于對(duì)票據(jù)行為的構(gòu)成的階段性認(rèn)識(shí)上的差異,二元論下票據(jù)行為分為票據(jù)債務(wù)承擔(dān)行為和票據(jù)債權(quán)移轉(zhuǎn)行為。二元論在比較了一元論中各理論的優(yōu)勢(shì)和缺陷基礎(chǔ)上,充分研究了票據(jù)行為中的有因行為和無因行為,并作出了區(qū)別。 票據(jù)無因性是票據(jù)的核心,其具有自身的獨(dú)立價(jià)值,在內(nèi)容上,各票據(jù)理論有著不同的觀點(diǎn)。以往理論下的對(duì)于抗辯的限制主要表現(xiàn)在對(duì)權(quán)利外觀理論的借用。而票據(jù)行為二階段理論在區(qū)分了票據(jù)行為各階段的構(gòu)成要件基礎(chǔ)上,進(jìn)一步細(xì)化了對(duì)于票據(jù)抗辯的限制制度。因此,作為票據(jù)無因性的表現(xiàn),票據(jù)抗辯制度將作為本文的核心內(nèi)容。 本文一共分為四章,在第一章介紹了票據(jù)無因性的相關(guān)理論,為全文行文做鋪墊。 第二章論述了本文所采用的理論基礎(chǔ)——票據(jù)行為二階段理論對(duì)于票據(jù)無因性適用范圍的影響。通過解釋該理論的主要容和構(gòu)成要件,為闡述后續(xù)內(nèi)容進(jìn)一步打好基礎(chǔ)。 第三章通過對(duì)傳統(tǒng)理論的反思,闡述了筆者在本文中·的一個(gè)核心觀點(diǎn),并由此建立了文章的理論基礎(chǔ)。 第四章類似于總結(jié)部分,對(duì)于現(xiàn)行的有關(guān)法條進(jìn)行了深入分析,提出筆者的建議。同時(shí)對(duì)票據(jù)抗辯制度進(jìn)行了綜合性的論述,是全文最為重要的部分。 全文通過對(duì)票據(jù)無因性的相關(guān)理論進(jìn)行比較分析,從而確立了對(duì)于票據(jù)無因性與票據(jù)抗辯制度之間關(guān)系的基本觀點(diǎn),在此基礎(chǔ)之上得出全文的結(jié)論。
[Abstract]:Compared with the non-causality in civil law, it has its own characteristics, which are manifested in its connotation and extension. In general, the theory of bill can be divided into monism and dualism in general. In monism, it is mainly the theory of delivery contract, the theory of distribution, the theory of creation, and the theory of right appearance as a remedy for the defects of monism is not an independent theory of instruments. Dualism refers to the two-stage theory of bill behavior. The difference between monism and dualism lies in the difference in the stage understanding of the composition of bill behavior. On the basis of comparing the advantages and disadvantages of various theories in monism, dualism fully studies the causative behavior and the non-cause behavior in the bill behavior. And made a distinction. Bill without cause is the core of bill, it has its own independent value, in content, Different theories of bill have different views. In the past, the limitation of defense is mainly manifested in the borrowing of the theory of the appearance of rights, while the two-stage theory of bill behavior distinguishes the constituent elements of each stage of the act of bill. It further refines the restriction system of the bill defense. Therefore, as the performance of the bill without cause, the bill defense system will be the core content of this paper. This paper is divided into four chapters. In the first chapter, the paper introduces the related theory of the non-causality of the bill and paves the way for the full text. The second chapter discusses the influence of the two-stage theory of bill behavior on the scope of application of the bill, which is the theoretical foundation adopted in this paper. By explaining the main contents and the constitutive requirements of the theory, it lays a good foundation for the further elaboration of the following contents. In the third chapter, through the reflection of the traditional theory, the author expounds a core point of view in this paper, and establishes the theoretical basis of the article. Chapter 4th is similar to the summary part. It makes a thorough analysis of the current relevant articles of law and puts forward the author's suggestions. At the same time, it makes a comprehensive discussion on the bill defense system, which is the most important part of the paper. Based on the comparative analysis of the relevant theories of the non-causality of the bill, this paper establishes the basic viewpoint of the relationship between the non-causality of the bill and the defense system of the bill, and draws the conclusion of the full text on this basis.
