【摘要】：我國《票據(jù)法》于1995年5月頒布，并在2004年8月進(jìn)行了細(xì)微的修改。隨著票據(jù)法修改呼聲的逐漸升高，全國票據(jù)法修改研討會如火如荼的進(jìn)行著。我們應(yīng)該抓準(zhǔn)票據(jù)法中的熱點(diǎn)、核心問題進(jìn)行研究與探討，力求為票據(jù)法律修改作出一定的理論貢獻(xiàn)。票據(jù)簽章是票據(jù)發(fā)生法律效力的重要條件。票據(jù)的很多法律問題，最終都可能和票據(jù)簽章有關(guān)。票據(jù)簽章在票據(jù)行為中的核心地位，，雖然得到學(xué)術(shù)界的普遍承認(rèn)，但對卻沒有幾個學(xué)者對其進(jìn)行深入研究，實(shí)為遺憾。 本文將圍繞票據(jù)簽章，對學(xué)術(shù)界存在爭議的票據(jù)簽章法律問題進(jìn)行研究。文章獨(dú)創(chuàng)性地提出，在權(quán)利外觀理論的幫助下，適用票據(jù)簽章最大有效性原則是具有合理性的。并且創(chuàng)新性的利用“最大有效性原則”的理念，引導(dǎo)異態(tài)票據(jù)簽章的法律效力研究，提出肯定某些異態(tài)票據(jù)簽章效力的觀點(diǎn)。在最大有效性原則和異態(tài)簽章部分有效的觀念基礎(chǔ)上，對票據(jù)簽章代理的責(zé)任規(guī)則進(jìn)行深入研究，提出解決票據(jù)簽章代理責(zé)任歸屬的基礎(chǔ)思路。
[Abstract]:China's negotiable Instruments Law was promulgated on May 1995 and slightly revised on August 2004. As the voice for the amendment of the Bill Law gradually rose, The national bill law revision seminar is going on like a raging fire. We should grasp the hot spots in the bill law and study and discuss the core issues. To make a certain theoretical contribution to the amendment of the bill law. Bill signature is an important condition for the legal effect of the bill. Many legal problems of the bill may eventually be related to the bill signature. The central position of the bill signature in the bill act, Although generally recognized by the academic community, but few scholars to conduct in-depth research, it is a pity. This paper will focus on the legal issues of bill signature, which is controversial in academic circles. The article proposes that, with the help of the theory of the appearance of rights, It is reasonable to apply the principle of maximum validity of bill signature. On the basis of the principle of maximum validity and the idea of partial validity of different signatures, this paper makes an in-depth study on the liability rules of the signature agency of bills. This paper puts forward the basic idea of solving the ascription of agency responsibility of bill signature.
