【摘要】：在我們共同享受工業(yè)文明帶來的繁榮時,環(huán)境污染、資源枯竭等問題也給我們乃至子孫后代的生活帶來嚴峻的威脅。保護環(huán)境,實施可持續(xù)發(fā)展已經成為全球共識,由工業(yè)文明向生態(tài)文明轉變已經成為社會發(fā)展的大趨勢。各國的環(huán)境保護實踐都說明,當前采用傳統(tǒng)的環(huán)境行政管理手段和法律手段已遠不能解決環(huán)境危機問題,積極運用金融調控等市場經濟手段,引導和刺激企業(yè)轉變經營理念,自主進行產業(yè)結構的調整和污染防治,積極追求經濟效益和環(huán)境效益的協(xié)調統(tǒng)-已經成為各國的普遍共識�！熬G色信貸”這一機制正是在這一社會經濟背景之下得以發(fā)揮其積極的經濟調控作用。 國際上對綠色信貸的研究起步較早,許多國際組織,國家政府和銀行等金融機構紛紛出臺政策,將環(huán)境保護與經濟措施聯(lián)系起來,通過規(guī)制銀行的信貸活動來促進環(huán)境保護。綠色信貸在中國正處于起步階段,目前我國已經基本建立了綠色信貸法律體系。但是不得不看到的是,我國綠色信貸制度還不完善,無論在管理制度上還是在操作技術上都還存在著一定問題,在執(zhí)行效果上仍亟待提高。 本文從綠色信貸的具體概念和背景入手,通過介紹國外和國內綠色信貸的立法實踐情況分析我國綠色信貸法律制度中存在的問題,并提出一些合理化建議。本文內容一共分為四個章節(jié),具體內容如下：第一章介紹綠色信貸的概念和提出的背景,對綠色信貸做一個概括性介紹。第二章介紹綠色信貸法律制度的國際實踐,包括國際組織,國外政府部門以及國外銀行業(yè)制定的綠色信貸相關規(guī)定以及其實施情況,為我國的綠色信貸提供借鑒經驗。第三章介紹我國綠色信貸的法律體系以及目前銀行業(yè)的執(zhí)行情況。第四章分析我國綠色信貸存在的主要問題,進而對于我國綠色信貸法律體系提出一些具體建議。
[Abstract]:When we enjoy the prosperity brought by industrial civilization together, environmental pollution, resource depletion and other problems have also brought us and future generations a serious threat to their lives and protect the environment. The implementation of sustainable development has become a global consensus, from industrial civilization to ecological civilization has become a major trend of social development. At present, it is far from being able to solve the problem of environmental crisis by using traditional environmental administrative means and legal means, and actively using market economy means such as financial regulation and control to guide and stimulate enterprises to change their business concepts. We will independently adjust the industrial structure and prevent pollution. It has become a common understanding of all countries to actively pursue the coordination of economic and environmental benefits, and the mechanism of "green credit" has been able to play its positive role in economic regulation under this social and economic background. International research on green credit started early, many international organizations, national governments and banks and other financial institutions have issued policies to link environmental protection with economic measures. Green credit is in its infancy in China. At present, the legal system of green credit has been basically established in China. China's green credit system is not perfect, whether in the management system or in the operational technology, there are still some problems, in the implementation of the effect still need to be improved. This article starts with the concrete concept and background of green credit, and analyzes the problems existing in the legal system of green credit in our country by introducing the legislative practice of green credit in foreign and domestic countries. The content of this paper is divided into four chapters, the specific content is as follows: the first chapter introduces the concept of green credit and the background. The second chapter introduces the international practice of the legal system of green credit, including international organizations. Foreign government departments and foreign banks to formulate the green credit regulations and their implementation. The third chapter introduces the legal system of green credit in China and the current implementation of the banking industry. Chapter 4th analyzes the main problems of green credit in China. Then put forward some concrete suggestions to our country green credit law system.
