【摘要】：近年來(lái),數(shù)字貿(mào)易發(fā)展迅猛,已經(jīng)成為全球經(jīng)濟(jì)的新增長(zhǎng)點(diǎn)。美國(guó)和歐盟是全球數(shù)字貿(mào)易治理體系構(gòu)建過(guò)程中兩個(gè)重要的參與者,甚至是核心引領(lǐng)者。但由于二者在數(shù)字產(chǎn)業(yè)競(jìng)爭(zhēng)力、文化傳統(tǒng)、民族心理等方面存在顯著差異,因而對(duì)于數(shù)字貿(mào)易治理方面的利益訴求存在嚴(yán)重分歧。通過(guò)對(duì)比美歐差異化的主張,分析其矛盾焦點(diǎn)及背后成因,著力于回答好3個(gè)關(guān)鍵性議題,即"跨境數(shù)據(jù)自由流動(dòng)""數(shù)據(jù)存儲(chǔ)本地化"和"個(gè)人隱私保護(hù)",并嘗試把握全球數(shù)字貿(mào)易規(guī)則的發(fā)展趨勢(shì),為中國(guó)數(shù)字貿(mào)易規(guī)則的制定提供借鑒。
[Abstract]:In recent years, the rapid development of digital trade has become a new growth point of the global economy. The United States and the European Union are two important participants, even the core leaders, in the process of building a global digital trade governance system. However, there are significant differences in the competitiveness of digital industry, cultural tradition, national psychology and so on, so there are serious differences in the interests of digital trade governance. By comparing the differences between the United States and Europe, the author analyzes the focus of the contradiction and the causes behind it, and tries to answer three key issues. That is, "the free flow of cross-border data", "localization of data storage" and "personal privacy protection", and attempts to grasp the development trend of global digital trade rules to provide reference for the formulation of digital trade rules in China.
