【摘要】：互聯(lián)網(wǎng)金融最早出現(xiàn)在美英等西方國家,近年在我國異軍突起,迅速滲透到經(jīng)濟(jì)社會(huì)生活各個(gè)領(lǐng)域中。作為金融與互聯(lián)網(wǎng)跨界融合的產(chǎn)物,互聯(lián)網(wǎng)金融既是一種以創(chuàng)新為動(dòng)力的市場行為,又是發(fā)展的必然趨勢。但是,互聯(lián)網(wǎng)金融不是法外之地,從事互聯(lián)網(wǎng)金融活動(dòng)應(yīng)該尊重和服從現(xiàn)行的法律規(guī)定。與對傳統(tǒng)金融的剛性管理不同,對互聯(lián)網(wǎng)金融應(yīng)多實(shí)行柔性管理,在當(dāng)前的法律框架內(nèi)將軟法與硬法,柔性與剛性管理相結(jié)合,結(jié)合國情開展制度創(chuàng)新,探索金融監(jiān)管變革的路徑與模式。
[Abstract]:Internet finance first appeared in the United States and Britain and other western countries. In recent years, it has suddenly emerged in our country and quickly penetrated into all fields of economic and social life. Internet finance is not only a market behavior driven by innovation, but also an inevitable trend of development. Different from the rigid management of traditional finance, Internet finance should be subject to flexible management, and soft law and hard law should be applied in the current legal framework. Combining flexibility with rigid management and combining with national conditions, this paper explores the path and mode of financial supervision reform.
