【摘要】：隨著網(wǎng)絡(luò)經(jīng)濟的迅猛發(fā)展,互聯(lián)網(wǎng)企業(yè)濫用市場支配地位實施的搭售行為日益增多,影響逐漸擴大,因此,有必要對其進行反壟斷法規(guī)制。根據(jù)反壟斷實務(wù)部門規(guī)制壟斷行為的一般路徑,規(guī)制互聯(lián)網(wǎng)企業(yè)搭售行為時,可遵循以下步驟:首先,從行為主體是否為具有市場支配地位的互聯(lián)網(wǎng)企業(yè),行為客觀方面是否違背用戶需求捆綁銷售互聯(lián)網(wǎng)產(chǎn)品兩個維度來進行事實判斷;其次,從是否存在限制競爭的主觀故意、對競爭有無實質(zhì)損害效果、實施搭售行為有無正當理由三個維度來進行違法性分析;最后,對違法的互聯(lián)網(wǎng)搭售行為據(jù)情節(jié)科以民事、行政和刑事責任。
[Abstract]:With the rapid development of network economy, Internet enterprise abusing the dominant market status of the implementation of tying behavior is increasing, influence gradually expanded, therefore, it is necessary to carry out anti-monopoly law to regulate it. According to the general path of Antitrust Practice Department monopoly, the regulation of Internet enterprise tying behavior, can follow the following steps: firstly, from whether the agent as the dominant Internet enterprise, the objective behavior is contrary to the needs of users in two dimensions of Internet sales bundled products to the fact judgment; secondly, from the existence of restrictive subjective intent, have the effect of no substantial damage to competition, the implementation of tying behavior without any justifiable reason to three dimensions of illegality finally, on the analysis; illegal tying behavior according to the plot, the Internet to civil, administrative and criminal liability.

【正文快照】： 一、問題的緣起隨著網(wǎng)絡(luò)經(jīng)濟的迅猛發(fā)展,互聯(lián)網(wǎng)企業(yè)濫用市場支配地位實施的搭售行為逐漸增多、危害日益擴大。“美國微軟案”、“韓國微軟案”、“奇虎訴騰訊案”等案即為明證。雖然各國反壟斷法均對搭售行為的規(guī)制作出了規(guī)定①,但是,這些規(guī)定均是針對傳統(tǒng)行業(yè)搭售行為而設(shè)。
