未竟的公共性:我國(guó)國(guó)有企業(yè)社會(huì)責(zé)任研究

【摘要】:在我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)體制下,國(guó)有企業(yè)因其產(chǎn)權(quán)公有的特殊性享有政策傾斜待遇與公共資源優(yōu)勢(shì),在增強(qiáng)自身實(shí)力的同時(shí),也推動(dòng)著我國(guó)整體經(jīng)濟(jì)水平的提高。然而,近年來(lái)部分國(guó)有企業(yè)因生產(chǎn)安全事故、惡性競(jìng)爭(zhēng)、環(huán)境污染等負(fù)面事件深陷輿論漩渦,引發(fā)了社會(huì)對(duì)國(guó)有企業(yè)社會(huì)責(zé)任問題的廣泛關(guān)注。本文認(rèn)為在我國(guó)以公有制為主體的基本經(jīng)濟(jì)制度下,國(guó)有企業(yè)是公有產(chǎn)權(quán)制度的重要表現(xiàn)形式和實(shí)現(xiàn)途徑,天生就具有實(shí)現(xiàn)和維護(hù)公共利益的公共屬性,國(guó)有企業(yè)的現(xiàn)實(shí)表現(xiàn)顯然與此理想目標(biāo)存在明顯差距。本文試圖跳出政府與市場(chǎng)"公-私"二分的傳統(tǒng)研究范式,從"公共性"角度出發(fā),將企業(yè)社會(huì)責(zé)任視為市場(chǎng)機(jī)制的深入發(fā)展所帶來(lái)的社會(huì)交換領(lǐng)域公共性擴(kuò)張的產(chǎn)物,因而具有公共屬性,屬于公共物品。企業(yè)因此成為推動(dòng)和完善公共治理不可或缺的重要力量。在當(dāng)前弘揚(yáng)合作治理的話語(yǔ)體系中,借助多元治理力量的互動(dòng)合作關(guān)系來(lái)構(gòu)建企業(yè)社會(huì)責(zé)任的實(shí)現(xiàn)機(jī)制成為一種新思路。在市場(chǎng)經(jīng)濟(jì)環(huán)境中運(yùn)營(yíng)的國(guó)有企業(yè)兼有經(jīng)濟(jì)性和公共性的雙重屬性,企業(yè)社會(huì)責(zé)任的公共性價(jià)值以及國(guó)有企業(yè)內(nèi)在的公共屬性要求國(guó)有企業(yè)以"公共性"為原則,協(xié)調(diào)好兩種屬性之間的關(guān)系,以積極承擔(dān)企業(yè)社會(huì)責(zé)任的方式實(shí)現(xiàn)維護(hù)公共利益、增進(jìn)社會(huì)福利的根本目標(biāo)。本文以我國(guó)經(jīng)濟(jì)體制變革過程為線索梳理了我國(guó)國(guó)有企業(yè)社會(huì)責(zé)任的演變過程,認(rèn)為無(wú)論是計(jì)劃經(jīng)濟(jì)時(shí)期的職能性責(zé)任,還是市場(chǎng)經(jīng)濟(jì)體制下的回應(yīng)性責(zé)任,兩者在根本上是一致的,都具有公共性特征。然而,在對(duì)現(xiàn)階段我國(guó)國(guó)有企業(yè)履行社會(huì)責(zé)任的狀況進(jìn)行考察時(shí),卻發(fā)現(xiàn)多年來(lái)國(guó)有企業(yè)積累起來(lái)的在經(jīng)濟(jì)和社會(huì)方面履責(zé)成就還不足以充分詮釋這種"公共性",目前存在的諸多失責(zé)行為在一定程度上對(duì)"公共性"產(chǎn)生了模糊效應(yīng)。究其原因,不僅在于市場(chǎng)機(jī)制的固有缺陷,還由于我國(guó)政治經(jīng)濟(jì)體制內(nèi)部也存在弊端。委托代理問題和治理模式行政化從企業(yè)內(nèi)部增加了國(guó)有企業(yè)產(chǎn)生失責(zé)行為的風(fēng)險(xiǎn),進(jìn)而又導(dǎo)致外部市場(chǎng)競(jìng)爭(zhēng)機(jī)制與社會(huì)監(jiān)督機(jī)制無(wú)法有效發(fā)揮作用。針對(duì)目前國(guó)有企業(yè)面臨的內(nèi)生性困境,結(jié)合其履責(zé)現(xiàn)狀,本文再一次回到"公共性"的出發(fā)點(diǎn),遵循社會(huì)交換領(lǐng)域的公共性擴(kuò)張帶來(lái)新的治理格局的思路,提出構(gòu)建政府-社會(huì)-企業(yè)主導(dǎo)的合作治理機(jī)制,主張依靠多元治理力量共同推動(dòng)我國(guó)國(guó)有企業(yè)社會(huì)責(zé)任水平的提高。雖然"公共性"的視角可能是本文的創(chuàng)新之處,但畢竟只是嘗試性的初步探索,論證分析主要屬于理論范疇,缺乏實(shí)證研究;對(duì)"合作治理"路徑的討論也僅僅停留在宏觀層面,微觀層面的實(shí)踐價(jià)值有所欠缺。
[Abstract]:Under the socialist market economy system of our country, the state-owned enterprises enjoy the preferential treatment of policy and the advantage of public resources because of the particularity of their property rights and public ownership, which not only enhance their own strength, but also promote the improvement of the overall economic level of our country. However, in recent years, some state-owned enterprises, due to production safety accidents, vicious competition, environmental pollution and other negative events in the public opinion whirlpool, has caused widespread concern about the social responsibility of state-owned enterprises. This paper holds that under the basic economic system in which the public ownership is the main body, the state-owned enterprises are the important manifestation and the way to realize the public property right system, and they have the public attribute of realizing and maintaining the public interest by nature. The realistic performance of state-owned enterprises obviously has obvious disparity with this ideal target. This paper tries to jump out of the traditional research paradigm of "public and private" between government and market, and from the perspective of "publicity", regards corporate social responsibility as the product of public expansion in the field of social exchange brought about by the further development of market mechanism. Therefore has the public attribute, belongs to the public goods. Therefore, enterprises have become an indispensable force to promote and improve public governance. In the current discourse system of cooperative governance, it is a new way to construct the realization mechanism of corporate social responsibility with the help of the interaction and cooperation of multiple governance forces. The state-owned enterprises operating in the market economy environment have the dual attributes of economy and publicity. The public value of corporate social responsibility and the inherent public attribute of state-owned enterprises require state-owned enterprises to take "publicity" as the principle. To coordinate the relationship between the two attributes and to realize the fundamental goal of safeguarding public interests and promoting social welfare in the way of actively undertaking corporate social responsibility. This article combs the evolution process of the social responsibility of the state-owned enterprises in our country with the clue of the reform process of the economic system of our country, and thinks that whether it is the functional responsibility in the planned economy period or the responsive responsibility under the market economy system, The two are fundamentally identical and both have the characteristics of publicity. However, during the investigation of the current situation of state-owned enterprises in our country in fulfilling their social responsibilities, However, it is found that the economic and social responsibilities accumulated by the state-owned enterprises over the years are not enough to fully explain the "publicity", and many of the current failures have a vague effect on the "publicity" to a certain extent. The reason lies not only in the inherent defects of market mechanism, but also in the internal political and economic system. The principal-agent problem and the administration of the governance mode increase the risk of the state-owned enterprises' default behavior from the inside of the enterprise, and then lead to the external market competition mechanism and the social supervision mechanism can not play an effective role. In view of the endogenous predicament faced by state-owned enterprises at present and the present situation of their responsibilities, this paper returns to the starting point of "publicity" once again, following the idea that the expansion of publicity in the field of social exchange will bring about a new governance pattern. This paper proposes to build a cooperative governance mechanism led by the government, society and enterprises, and advocates to rely on the power of multiple governance to jointly promote the improvement of the level of social responsibility of state-owned enterprises in China. Although the angle of view of "publicity" may be the innovation of this paper, it is only a tentative exploration after all. The demonstration and analysis mainly belong to the theoretical category and lack of empirical research. The discussion on the path of "cooperative governance" only stays at the macro level and lacks the practical value at the micro level.
