【摘要】：操縱證券市場(chǎng)犯罪案件是一種嚴(yán)重的證券犯罪案件,它對(duì)我國(guó)證券市場(chǎng)的健康發(fā)展具有嚴(yán)重危害性,因而是證券監(jiān)管部門和司法機(jī)關(guān)打擊的重點(diǎn)。但在實(shí)踐中,偵查機(jī)關(guān)在辦理操縱證券市場(chǎng)犯罪案件時(shí)往往會(huì)遇到許多困難,如發(fā)現(xiàn)難、取證難、認(rèn)定難等問(wèn)題使得偵查機(jī)關(guān)陷入被動(dòng)。當(dāng)然,這些偵查難點(diǎn)產(chǎn)生的原因是多方面的,包括我國(guó)證券市場(chǎng)自身的因素、操縱行為人方面的因素、偵查機(jī)關(guān)方面的因素以及相關(guān)法律制度的不完善。偵查機(jī)關(guān)應(yīng)當(dāng)結(jié)合自身的實(shí)際情況,從多個(gè)方面探討應(yīng)對(duì)之策,如完善案件線索發(fā)現(xiàn)機(jī)制,擴(kuò)大案件來(lái)源;強(qiáng)化偵查人員的偵查意識(shí),提高專業(yè)素質(zhì);根據(jù)案件特點(diǎn),確定偵查途徑;不斷完善偵查措施,采取多種偵查手段等。
[Abstract]:The crime case of manipulating the securities market is a kind of serious securities crime case, it has serious harm to the healthy development of the securities market of our country, therefore it is the focal point of the securities supervision department and the judicial organ to crack down. However, in practice, the investigative organs often encounter many difficulties in handling criminal cases of manipulating the securities market, such as difficult to find, obtain evidence, identify difficulties, and so on, which makes the investigation organs fall into a passive position. Of course, there are many reasons for these difficulties, including the factors of our country's securities market, the factors of manipulating the actors, the factors of the investigation organs and the imperfections of the relevant legal system. The investigation organ should combine its own actual situation and probe into the countermeasures from many aspects, such as perfecting the mechanism of finding the case clues, expanding the source of the case, strengthening the investigation consciousness of the investigators, improving the professional quality, and according to the characteristics of the case, To determine the way of investigation, to improve the investigation measures, to adopt various investigative techniques, etc.
