【摘要】:本文在對(duì)小產(chǎn)權(quán)房成因、現(xiàn)狀、發(fā)展過(guò)程進(jìn)行梳理的基礎(chǔ)上,通過(guò)博弈論的方法和國(guó)外土地發(fā)展權(quán)的理論結(jié)合中國(guó)的實(shí)際情況,對(duì)小產(chǎn)權(quán)房的治理措施進(jìn)行了制度上的設(shè)計(jì)。要解決已建成的規(guī)模龐大的小產(chǎn)權(quán)房問(wèn)題,關(guān)鍵是如何做到在不損害人民群眾利益的前提下平衡各利益相關(guān)方的利益,在保持社會(huì)穩(wěn)定的前提下,妥善地處理該問(wèn)題。本文主要運(yùn)用博弈論和土地發(fā)展權(quán)理論來(lái)解決小產(chǎn)權(quán)房問(wèn)題,目的是希望為從根本上解決小產(chǎn)權(quán)房問(wèn)題提出可行的措施,為政府出臺(tái)正式的治理措施提供參考。由于目前已建成的小產(chǎn)權(quán)房問(wèn)題至少涉及政府、農(nóng)民、小產(chǎn)權(quán)房購(gòu)買(mǎi)者、房地產(chǎn)開(kāi)發(fā)商等幾個(gè)利益主體。而通過(guò)對(duì)各方態(tài)度的分析,初步可以得出一個(gè)結(jié)論,那就是使已建成的小產(chǎn)權(quán)房分類(lèi)并加以合法化將是解決存量小產(chǎn)權(quán)房問(wèn)題的主要途徑。小產(chǎn)權(quán)房不僅是土地問(wèn)題、也不僅是一個(gè)法律和制度問(wèn)題,它更是一個(gè)社會(huì)問(wèn)題。小產(chǎn)權(quán)房涉及眾多利益主體的利益問(wèn)題,一旦處理不慎將會(huì)出現(xiàn)社會(huì)動(dòng)蕩,影響社會(huì)穩(wěn)定和損壞經(jīng)濟(jì)發(fā)展的良好環(huán)境。而已建成的小產(chǎn)權(quán)房作為小產(chǎn)權(quán)房問(wèn)題的一個(gè)重要組成部分更是政府迫切需要解決的問(wèn)題,而由于其牽涉面太廣,政府到現(xiàn)在還沒(méi)有出臺(tái)一個(gè)處理該問(wèn)題的策略。這不但說(shuō)明政府對(duì)這個(gè)問(wèn)題的謹(jǐn)慎和重視,同時(shí)也說(shuō)明政府在這個(gè)問(wèn)題上非常為難。本文選擇這個(gè)問(wèn)題來(lái)具體討論解決小產(chǎn)權(quán)房的一些方式以及怎樣維護(hù)各個(gè)利益主體的利益,具有強(qiáng)烈的現(xiàn)實(shí)意義和理論意義。本文提出的治理措施主要是基于兼顧國(guó)家、集體、個(gè)人利益提出的,小產(chǎn)權(quán)房涉及到眾多利益主體的利益問(wèn)題,一旦處理不慎將影響社會(huì)穩(wěn)定,損壞經(jīng)濟(jì)發(fā)展的大環(huán)境。政府在該問(wèn)題的解決上必須堅(jiān)持非常謹(jǐn)慎地態(tài)度進(jìn)行,以建設(shè)服務(wù)型政府為目標(biāo),本著讓利于民、服務(wù)群眾的態(tài)度建立土地發(fā)展權(quán),加快農(nóng)村土地確權(quán)登記,建立土地價(jià)格形成機(jī)制,加強(qiáng)監(jiān)督利益分配過(guò)程,做到土地流轉(zhuǎn)的監(jiān)督者和護(hù)航者。本文明確提出以土地所有權(quán)和發(fā)展權(quán)相分離的方式來(lái)解決小產(chǎn)權(quán)房問(wèn)題,通過(guò)設(shè)計(jì)一整套的土地流轉(zhuǎn)方式來(lái)消除小產(chǎn)權(quán)房發(fā)展的根基,徹底解決該問(wèn)題。
[Abstract]:On the basis of combing the causes, the present situation and the development process of the small property right house, this paper designs the system of the small property house management measures through the method of game theory and the theory of foreign land development right combined with the actual situation of China.In order to solve the problem of small property right which has been built on a large scale, the key is how to balance the interests of all stakeholders on the premise of not harming the interests of the people, and properly deal with this problem on the premise of maintaining social stability.This article mainly uses the game theory and the land development right theory to solve the small property house problem, the purpose is to put forward the feasible measure for solving the problem of the small property house fundamentally, provides the reference for the government to issue the formal management measure.Because the problem of the small property house that has already been built at least involves the government, the farmer, the buyer of the small property house, the real estate developer and so on several benefit main bodies.Through the analysis of the attitudes of all parties, we can draw a conclusion that the main way to solve the problem is to classify and legalize the small property houses that have been built.The small property house is not only a land problem, but also a legal and institutional problem, it is also a social problem.House of small property rights involves the interests of many stakeholders. Once handled carelessly, there will be social unrest, which will affect social stability and damage the good environment of economic development.As an important part of the problem of small property housing, the government urgently needs to solve the problem, but because of its wide scope, the government has not yet issued a strategy to deal with this problem.This not only shows the caution and importance of the government, but also shows that the government is very difficult on this issue.It is of great practical and theoretical significance to choose this question to discuss some ways of solving the problem of small property right house and how to safeguard the interests of various stakeholders.The governance measures put forward in this paper are mainly based on the consideration of the national, collective and individual interests. The small property right housing involves the interests of many interest parties. Once handled carelessly, it will affect social stability and damage the general environment of economic development.In order to solve this problem, the government must adhere to a very cautious attitude, take the construction of a service-oriented government as the goal, set up the land development right in an attitude of giving way to the interests of the people and serving the masses, and speed up the registration of rural land rights.Establish land price formation mechanism, strengthen the supervision of the process of interest distribution, and achieve land circulation supervisor and escort.In this paper, the separation of land ownership and development right is put forward to solve the problem of small property house, and a whole set of land transfer method is designed to eliminate the foundation of the development of small property house, and to solve the problem thoroughly.
