【摘要】：我國融資租賃市場近30年來取得了長足的發(fā)展,成為我國現(xiàn)代市場經(jīng)濟體系不可替代的組成部分,是繼銀行信貸后,金融市場第二大融資手段,其穩(wěn)定性直接關系到我國國民經(jīng)濟的健康發(fā)展,如何加強政府對融資租賃市場的監(jiān)管已經(jīng)成了世界性的問題,許多國家的政府及學術界都保持著較高關注度。本文立足于我國政府對融資租賃市場的監(jiān)督管理現(xiàn)狀,以我國融資租賃市場的發(fā)展為研究背景,以信息不對稱理論、市場失靈理論和公共利益論為研究依據(jù),分析當前我國政府對融資租賃市場監(jiān)管中主要存在著以下幾方面的問題:(1)政府對融資租賃市場監(jiān)管目標狹窄,對融資租賃市場干預過多;(2)政府市場監(jiān)管權限不清,導致了“一個市場、兩套監(jiān)管體系、三種企業(yè)準入”的市場現(xiàn)狀;(3)融資租賃立法領域存在大片空白,且執(zhí)法力度較弱;(4)我國融資租賃市場缺乏相關配套政策支持。究其原因,主要是:(1)我國政府對融資租賃市場的認識不足;(2)政府對融資租賃市場監(jiān)管經(jīng)營不足;(3)融資租賃法律體系不健全、法律文件不統(tǒng)一,立法部門制定和執(zhí)行法律能力有限;(4)我國政府尚未充分引導發(fā)揮融資租賃行業(yè)內(nèi)部監(jiān)管的作用。比較借鑒國際經(jīng)驗,我國政府應該積極采取以下對策:(1)政府應設置明確的監(jiān)管目標,調(diào)整監(jiān)督管理理念;(2)融資租賃監(jiān)管主體應進一步規(guī)范化,尋求政府監(jiān)管與市場機制的平衡;(3)逐步完善融資租賃市場監(jiān)管的法律體系;(4)強化融資租賃市場相關配套政策的實施。
[Abstract]:The financial leasing market of our country has made great progress in the past 30 years and has become an irreplaceable part of the modern market economy system of our country. It is the second largest financing means in the financial market after bank credit. Its stability is directly related to the healthy development of our national economy. How to strengthen government supervision of the financial leasing market has become a worldwide problem. The government and academic circles in many countries have maintained a high degree of attention. This paper is based on the current situation of supervision and management of the financial leasing market in our country, taking the development of the financial lease market in China as the research background and the theory of information asymmetry. Based on the theory of market failure and the theory of public interest, this paper analyzes the main problems existing in the supervision of the financial leasing market by our government at present: the following problems exist: (1) the government has a narrow goal of supervising the financial lease market. The unclear supervision authority of government market leads to the market situation of "one market, two regulatory systems and three kinds of enterprises". 3) there is a large gap in the field of financial leasing legislation. And the enforcement of the law is relatively weak. 4) China's financial leasing market lacks relevant policy support. The main one is: 1) the Chinese government does not have a good understanding of the financial leasing market. (2) the government has inadequate supervision and management of the financial leasing market. (3) the legal system of financial leasing is not perfect and the legal documents are not unified. Our government has not yet fully guided the role of internal supervision in the financial leasing industry. The Chinese government should actively adopt the following countermeasures: 1) the government should set clear supervision objectives, adjust the supervisory management concept and 2) the subject of supervision of financial leasing should be further standardized. To seek a balance between government supervision and market mechanism (3) to gradually improve the legal system of financial leasing market supervision 4) to strengthen the implementation of supporting policies related to the financial leasing market.
