【摘要】：我國(guó)高校在科研活動(dòng)中積累了大量的專利,如果能把這些專利成果成功應(yīng)用于社會(huì)生產(chǎn)領(lǐng)域,將創(chuàng)造出巨大的經(jīng)濟(jì)效益和社會(huì)價(jià)值。相關(guān)學(xué)者對(duì)我國(guó)高�？萍汲晒D(zhuǎn)化做了許多研究,但現(xiàn)有的大部分研究都側(cè)重于如何改進(jìn)現(xiàn)有的高校專利轉(zhuǎn)化模式,專門針對(duì)高校專利定價(jià)的研究卻較少。專利許可是高校專利技術(shù)轉(zhuǎn)化實(shí)施的一種重要形式,而專利許可定價(jià)是實(shí)施專利許可的一項(xiàng)關(guān)鍵性前置工作。定價(jià)是專利持有方以及許可實(shí)施方進(jìn)行決策的重要依據(jù),確保專利許可價(jià)格的公正合理也是高校國(guó)有資產(chǎn)管理的客觀要求。因此總結(jié)出適用于高校專利許可的定價(jià)方案,對(duì)于提升高校專利管理水平,促進(jìn)高校專利技術(shù)轉(zhuǎn)化都具有積極意義。論文首先分析了高校專利的特點(diǎn),指出高校專利許可定價(jià)應(yīng)該以收益為基礎(chǔ),充分考慮專利實(shí)施過(guò)程中收益的波動(dòng)。其次論文分析了高校專利許可定價(jià)的影響因素及現(xiàn)狀,針對(duì)現(xiàn)有方法的不足,文章提出了運(yùn)用二叉樹期權(quán)定價(jià)法,在收益現(xiàn)值的基礎(chǔ)上計(jì)算專利許可定價(jià)方案。最后運(yùn)用這種定價(jià)方案分析實(shí)際高校專利許可案例,詳細(xì)說(shuō)明該方案的計(jì)算步驟,將計(jì)算結(jié)果與實(shí)際許可價(jià)格進(jìn)行比較,并對(duì)產(chǎn)生差異的原因進(jìn)行了分析。通過(guò)研究,論文給出了針對(duì)高校專利許可定價(jià)的建議:定價(jià)需要綜合考慮被許可方、市場(chǎng)條件等多項(xiàng)因素,從而提高定價(jià)的準(zhǔn)確性;對(duì)于專利實(shí)施過(guò)程中的收益波動(dòng),要使用針對(duì)性的方法,如本文中運(yùn)用的二叉樹期權(quán)法,進(jìn)行客觀的分析;由于雙方的信息不完全對(duì)稱,發(fā)明人在專利許可定價(jià)過(guò)程中可能處于劣勢(shì),所以要更多借助專利評(píng)估專家的幫助;如果市場(chǎng)變化劇烈,專利許可定價(jià)可以按照實(shí)施的進(jìn)度分階段予以確定。
[Abstract]:Colleges and universities in our country have accumulated a large number of patents in scientific research activities. If we can successfully apply these patent achievements to the field of social production, we will create great economic benefits and social values.Relevant scholars have done a lot of research on the transformation of scientific and technological achievements in colleges and universities in China, but most of the existing studies have focused on how to improve the existing mode of patent transformation in colleges and universities, but there is little research on patent pricing in colleges and universities.Patent license is an important form of patent technology transformation in colleges and universities, and patent license pricing is a key prerequisite for patent licensing.Pricing is an important basis for patent holders and licensees to make decisions, and it is also an objective requirement for the management of state-owned assets in colleges and universities to ensure the fairness and reasonableness of patent license prices.Therefore, it is of positive significance to sum up the pricing scheme which is suitable for the patent license in colleges and universities, which will promote the level of patent management and the transformation of patent technology in colleges and universities.Firstly, this paper analyzes the characteristics of university patent, and points out that the pricing of university patent license should be based on the income, and the fluctuation of the income in the process of patent implementation should be fully considered.Secondly, the paper analyzes the influencing factors and current situation of the patent license pricing in colleges and universities. In view of the shortcomings of the existing methods, this paper puts forward a scheme to calculate the patent license pricing on the basis of the present value of income by using the binomial tree option pricing method.Finally, this pricing scheme is used to analyze the actual cases of university patent license, the calculation steps of the scheme are explained in detail, the calculation results are compared with the actual license price, and the reasons for the difference are analyzed.Through the research, the paper gives the suggestions for the university patent license pricing: the pricing needs to consider the Licensee, market conditions and other factors, so as to improve the accuracy of pricing.We should use targeted methods, such as the binomial tree option method used in this paper, to carry out an objective analysis. Because the information between the two parties is not completely symmetrical, the inventor may be at a disadvantage in the process of pricing the patent license.If the market changes dramatically, patent license pricing can be determined in stages according to the progress of implementation.
