【摘要】：正[編者按]市場(chǎng)經(jīng)濟(jì)的發(fā)展離不開有效的監(jiān)管,市場(chǎng)監(jiān)管法作為經(jīng)濟(jì)法的重要組成部分在其中發(fā)揮著舉足輕重的作用。近年來(lái),在食品、藥品等實(shí)體經(jīng)濟(jì)領(lǐng)域接連發(fā)生的惡性事件,以及證券、期貨等虛擬經(jīng)濟(jì)市場(chǎng)中屢禁不止的欺詐行為都要求對(duì)市場(chǎng)監(jiān)管法律制度予以改革和完善。要真正建立起以有效性為核心的市場(chǎng)監(jiān)管法律制度,真正實(shí)現(xiàn)市場(chǎng)的公平、公正和有序,就必須反思我國(guó)當(dāng)前的市場(chǎng)監(jiān)管體制是否合理、監(jiān)管理念是否契合市場(chǎng)經(jīng)濟(jì)的需求、政府監(jiān)管機(jī)構(gòu)的設(shè)置是否得當(dāng)、監(jiān)管權(quán)的配置是否科學(xué)、多元化的監(jiān)管體系是否發(fā)揮了應(yīng)有的作用等問題。有鑒于此,本編輯部特從華東政法大學(xué)經(jīng)濟(jì)法律
[Abstract]:[editor's note] is the development of the market economy cannot do without effective supervision, as an important part of economic law of the market regulation law plays an important role in it. In recent years, in the food, a spate of vicious incident, medicine and other areas of the real economy and securities fraud, futures and other virtual economic market repeated more than the requirements of market supervision law to reform and improve the system. To really establish the effectiveness of the market as the core of the legal supervision system, realize the market fair, fair and orderly, it must be the current market regulatory system to reflect China's regulatory philosophy is reasonable, whether fit the needs of the market economy, the government regulatory agencies set properly, the supervision right of disposition is scientific, diversified supervision system is to play its due role and other issues.
