陜西農(nóng)地經(jīng)營權(quán)抵押貸款影響因素研究

【摘要】:隨著農(nóng)地經(jīng)營的市場化、多元化程度加深,農(nóng)業(yè)經(jīng)營主體對農(nóng)業(yè)產(chǎn)業(yè)化經(jīng)營的資金需求日益加大,現(xiàn)代農(nóng)業(yè)生產(chǎn)所需資金僅靠金融機(jī)構(gòu)提供的小額貸款已無法得到滿足。農(nóng)地經(jīng)營權(quán)抵押實(shí)質(zhì)是一種準(zhǔn)產(chǎn)權(quán)抵押,推行農(nóng)地經(jīng)營權(quán)抵押貸款,能有效破解農(nóng)業(yè)經(jīng)營主體因?yàn)槿狈Φ盅簱?dān)保物而無法融資的困境。因此,為有效解決農(nóng)戶融資難的問題,我國政府逐步開始推進(jìn)農(nóng)地金融改革,在全國30個(gè)省份開展農(nóng)地經(jīng)營權(quán)抵押貸款試點(diǎn)工作并取得了一定的成效,但在實(shí)踐中也存在諸多制約農(nóng)地經(jīng)營權(quán)抵押貸款有序推進(jìn)的因素。因此深入研究開展農(nóng)地經(jīng)營權(quán)抵押貸款的影響因素,不僅有助于緩解農(nóng)業(yè)經(jīng)營主體“融資難”問題,更事關(guān)我國農(nóng)地產(chǎn)權(quán)制度的改革和農(nóng)業(yè)產(chǎn)業(yè)化、現(xiàn)代化的持續(xù)發(fā)展;诖,本文以土地產(chǎn)權(quán)理論、金融抑制理論和供求均衡理論為指導(dǎo),采用實(shí)證分析和規(guī)范分析相結(jié)合的方法,對陜西開展農(nóng)地經(jīng)營權(quán)抵押貸款業(yè)務(wù)的影響因素這一核心問題展開研究。首先,以農(nóng)地權(quán)屬和法律規(guī)范等方面為切入點(diǎn),對農(nóng)地經(jīng)營權(quán)抵押貸款展開創(chuàng)新性分析,提出“三權(quán)分置”是農(nóng)地抵押的一種體制創(chuàng)新,開展農(nóng)地經(jīng)營權(quán)抵押貸款是中國資本市場上的一種新模式,有利于農(nóng)地規(guī)模經(jīng)營和產(chǎn)業(yè)化經(jīng)營,實(shí)現(xiàn)農(nóng)民增收。其次,立足于陜西實(shí)際,揭示陜西農(nóng)地經(jīng)營權(quán)抵押貸款現(xiàn)狀及存在的主要問題。接著,通過構(gòu)建二項(xiàng)Logistic回歸模型和層次分析法相結(jié)合的分析范式,從需求和供給兩個(gè)角度揭示影響陜西開展農(nóng)地經(jīng)營權(quán)抵押貸款的影響因素,為有序推進(jìn)陜西農(nóng)地經(jīng)營權(quán)抵押貸款業(yè)務(wù)提供定量方法支撐,研究認(rèn)為現(xiàn)階段陜西農(nóng)地經(jīng)營權(quán)抵押貸款市場處于“供給主導(dǎo)”的非均衡狀態(tài)。最后立足于實(shí)證結(jié)果和陜西實(shí)際,得出順利推行農(nóng)地經(jīng)營權(quán)抵押貸款業(yè)務(wù)應(yīng)當(dāng)遵循供求均衡理論,統(tǒng)籌設(shè)計(jì),同時(shí)加強(qiáng)法制建設(shè),形成農(nóng)業(yè)經(jīng)營主體、金融機(jī)構(gòu)和政府三方聯(lián)動(dòng)機(jī)制等結(jié)論。
[Abstract]:With the marketization of agricultural land management and the deepening of diversification, the main body of agricultural management needs more and more funds for agricultural industrialization management, and the funds required for modern agricultural production can not be satisfied only by the small loans provided by financial institutions. The essence of farmland management right mortgage is a kind of quasi-property right mortgage. The implementation of farmland management right mortgage loan can effectively solve the dilemma that the agricultural management main body can not finance because of the lack of mortgage collateral. Therefore, in order to effectively solve the problem of farmers' financing difficulties, the Chinese government has gradually started to promote the reform of agricultural land finance, and has achieved certain results in the pilot work of mortgage loans for the management of agricultural land in 30 provinces of the country. But in practice, there are many factors that restrict the promotion of farmland management right mortgage loan. Therefore, it is not only helpful to alleviate the problem of "financing difficulty" but also related to the reform of farmland property right system and the sustainable development of agricultural industrialization and modernization. Based on this, this paper, guided by land property right theory, financial suppression theory and supply and demand equilibrium theory, adopts the method of combining empirical analysis with normative analysis. This paper studies the influence factors of agricultural land management right mortgage loan in Shaanxi province. First of all, starting from the ownership of agricultural land and the legal norms, this paper analyzes the innovation of the mortgage loan of farmland management right, and puts forward that "three rights separate structure" is a kind of system innovation of farmland mortgage. It is a new mode in Chinese capital market to develop the mortgage loan of farmland management right, which is beneficial to the scale management and industrialization management of agricultural land, and to realize the increase of farmers' income. Secondly, based on the reality of Shaanxi Province, it reveals the current situation and main problems of the mortgage loan of agricultural land management right in Shaanxi Province. Then, by constructing the binomial Logistic regression model and analytic hierarchy process, the paper reveals the influence factors on the development of agricultural land management right mortgage loan in Shaanxi province from the perspective of demand and supply. In order to promote the operation of agricultural land mortgage loan business in Shaanxi Province in an orderly manner, it is considered that the mortgage loan market of agricultural land management right in Shaanxi is in a supply-oriented unbalanced state at the present stage. Finally, based on the empirical results and the actual situation in Shaanxi, it is concluded that the smooth implementation of agricultural land management right mortgage loan business should follow the theory of equilibrium between supply and demand, design as a whole, strengthen the construction of legal system, and form the main body of agricultural management. Financial institutions and government tripartite linkage mechanism and other conclusions.
