【摘要】：1982年,黨中央發(fā)布第一個“一號文件”。迄今為止,33個“一號文件”始終強(qiáng)調(diào)農(nóng)村的改革、發(fā)展和建設(shè)。2013年11月黨十八屆三中全會以及2014年1月中共中央、國務(wù)院印發(fā)《關(guān)于全面深化農(nóng)村改革加快推進(jìn)農(nóng)業(yè)現(xiàn)代化的若干意見》(以下簡稱《意見》),再次將農(nóng)村改革確立為“三農(nóng)”工作的核心。其中,農(nóng)村土地制度改革主要包括完善農(nóng)村土地承包政策、引導(dǎo)和規(guī)范農(nóng)村集體經(jīng)營性建設(shè)用地入市、完善農(nóng)村宅基地管理制度以及加快推進(jìn)征地制度改革等四項(xiàng)內(nèi)容。本文即以此為立論點(diǎn),剖析農(nóng)村土地制度改革舉措的利弊、風(fēng)險,探究解決相應(yīng)問題的舉措。除引言和結(jié)語外,本文分為四個部分。第一部分:我國農(nóng)村土地制度的概況。本部分通過對農(nóng)村土地承包經(jīng)營權(quán)概況、農(nóng)村集體經(jīng)營性建設(shè)用地使用權(quán)概況以及農(nóng)村宅基地使用權(quán)概況分析,以便更能全面剖析現(xiàn)行農(nóng)村土地制度所存在的問題。第二部分:我國農(nóng)村土地制度改革舉措之介紹。該部分主要立足于2014年《關(guān)于全面深化農(nóng)村改革加快推進(jìn)農(nóng)業(yè)現(xiàn)代化的若干意見》中共中央一號文件。第三部分:我國農(nóng)村土地制度改革舉措之風(fēng)險預(yù)估。該部分分別對農(nóng)村土地承包經(jīng)營權(quán)、農(nóng)村集體經(jīng)營性建設(shè)用地入市以及農(nóng)村宅基地制度改革所存在的問題進(jìn)行全面分析,方便對規(guī)避我國農(nóng)村土地制度改革進(jìn)程中可能遇到的問題提出更具有針對性的規(guī)制措施。第四部分:我國農(nóng)村土地制度改革舉措之風(fēng)險規(guī)制。該部分主要針對第三部分對改革舉措所存在風(fēng)險預(yù)估提出的完善措施。
[Abstract]:In 1982, the CPC Central Committee issued the first document. To date, 33 "No 1" documents have consistently emphasized rural reform, development and construction. The third Plenary session of the 18th CPC Central Committee in November 2013 and the CPC Central Committee in January 2014, The State Council issued several opinions on comprehensively deepening rural reform and speeding up agricultural modernization (hereinafter referred to as "opinions"), which once again established rural reform as the core of the work of "agriculture, rural areas and farmers". Among them, the reform of rural land system mainly includes four contents: perfecting the rural land contract policy, guiding and standardizing the rural collective management construction land entering the market, perfecting the rural homestead management system and speeding up the reform of the land requisition system. This paper analyzes the advantages, disadvantages and risks of the reform of rural land system, and probes into the measures to solve the corresponding problems. In addition to the introduction and conclusion, this article is divided into four parts. The first part: the general situation of rural land system in China. This part analyzes the general situation of the rural land contractual management right, the rural collective operating construction land use right and the rural homestead use right in order to analyze the existing problems of the current rural land system. The second part: the introduction of rural land system reform in China. This part is mainly based on the No. 1 document of the CPC Central Committee on comprehensively deepening Rural Reform and speeding up Agricultural Modernization in 2014. The third part: the risk estimate of rural land system reform in China. In this part, the author makes a comprehensive analysis of the problems existing in the reform of the rural land contractual management right, the rural collective management construction land and the reform of the rural homestead system. It is convenient to put forward more targeted regulation measures to avoid the problems that may be encountered in the reform process of rural land system in our country. The fourth part: the risk regulation of rural land system reform in China. This part mainly aims at the third part to the reform measure existence risk forecast proposed the consummation measure.
