【摘要】：農(nóng)村集體建設(shè)用地流轉(zhuǎn)問題一直是國土人和法律界探討的焦點(diǎn)之一,現(xiàn)階段,我國的國有土地出讓、轉(zhuǎn)讓、出租等系列法律法規(guī)和配套政策相對完善,集體土地流轉(zhuǎn)制度相對滯后。隨著愈發(fā)嚴(yán)厲的耕地保護(hù)政策執(zhí)行,愈發(fā)昂貴的耕地占補(bǔ)平衡指標(biāo)費(fèi),在當(dāng)前不斷攀長的土地市場價格和供不應(yīng)求的建設(shè)用地面前,集體建設(shè)用地也開始逐漸成為了各級政府和企業(yè)關(guān)注的“香餑餑”。如何促進(jìn)農(nóng)村集體建設(shè)用地合理合法流轉(zhuǎn),已在全國各省市,尤其是經(jīng)濟(jì)發(fā)達(dá)地區(qū)開始作為試點(diǎn)施行。舟山作為海島城市,人多地少是普遍共識,如何利用好一千多個大小島域,推進(jìn)漁農(nóng)村集體建設(shè)用地流轉(zhuǎn),促進(jìn)土地資源集約節(jié)約利用,將是新區(qū)發(fā)展不可避免的一重要課題。本文主要通過對現(xiàn)行國內(nèi)外農(nóng)村集體建設(shè)用地管理相關(guān)的土地制度進(jìn)行分析,比對了國內(nèi)外在土地征收、土地信托和土地整理三個方面的模式研究,探討了舟山市這個土地資源極度匱乏的“群島新區(qū)”,實(shí)現(xiàn)漁農(nóng)村集體建設(shè)用地流轉(zhuǎn)的必要性、可行性和現(xiàn)實(shí)意義,初步探索了適合舟山地區(qū)漁農(nóng)村集體建設(shè)用地流轉(zhuǎn)的模式、程序和路徑選擇,并對今后逐步推進(jìn)我市的漁農(nóng)村集體建設(shè)用地流轉(zhuǎn),保障漁農(nóng)民權(quán)益工作提出了部分意見和建議。
[Abstract]:The circulation of rural collective construction land has always been one of the focal points discussed by the land people and the legal profession. At the present stage, the series of laws, regulations and supporting policies for the sale, transfer and lease of state-owned land in our country are relatively perfect. Collective land circulation system lags behind. With the implementation of more and more stringent policies on cultivated land protection, the more expensive cultivated land is charged for the compensation balance, in the face of the growing market price of land and the shortage of construction land, Collective construction land has gradually become the focus of government and enterprises at all levels. How to promote the rational and legal circulation of rural collective construction land has been implemented as a pilot project in provinces and cities, especially in economically developed areas. As an island city, Zhoushan is generally agreed that how to make good use of more than one thousand large islets, to promote the circulation of collective construction land in the fishing and fishery areas, and to promote the intensive and economical utilization of land resources will be an inevitable and important task for the development of the new area. Through the analysis of the land system related to the management of rural collective construction land at home and abroad, this paper compares the models of land expropriation, land trust and land consolidation at home and abroad. This paper probes into the necessity, feasibility and practical significance of realizing the transfer of agricultural and fishery rural collective construction land in Zhoushan City, which is a "new archipelagic area", which is extremely short of land resources, and preliminarily explores the mode suitable for the circulation of rural collective construction land in Zhoushan area. The procedure and path are chosen, and some opinions and suggestions are put forward to gradually promote the circulation of collective construction land in our city in the future, and to protect the rights and interests of fishery farmers.
