【摘要】：隨著新型城鎮(zhèn)化推進(jìn)使得農(nóng)村集體建設(shè)用地流轉(zhuǎn)成為焦點(diǎn)。但是目前農(nóng)村集體建設(shè)用地流轉(zhuǎn)的制度障礙主要體現(xiàn)在現(xiàn)行《憲法》第10條、《土地管理法》第43條、第63條以及《物權(quán)法》《擔(dān)保法》的限制性規(guī)定。土地流轉(zhuǎn)的地方法治實(shí)踐已經(jīng)突破了國(guó)家現(xiàn)行法律的限制,主要體現(xiàn)在,農(nóng)村集體建設(shè)用地使用權(quán)流轉(zhuǎn)用途非農(nóng)化、流轉(zhuǎn)方式多樣化以及宅基地流轉(zhuǎn)方面。地方政府積極推動(dòng)農(nóng)村集體建設(shè)用地使用權(quán)流轉(zhuǎn)和地方政府對(duì)土地財(cái)政的依賴(lài)有直接的關(guān)系,地方法治探索有利于推動(dòng)國(guó)家法治的發(fā)展完善,但是這種探索需要在法治框架下進(jìn)行,使得農(nóng)民個(gè)體的權(quán)益能夠得到最終維護(hù)和保障。
[Abstract]:With the development of new urbanization, the circulation of rural collective construction land becomes the focus. However, at present, the institutional obstacles to the circulation of rural collective construction land are mainly reflected in the restrictive provisions of Article 10 of the present Constitution, Article 43 of the Land Management Law, Article 63 of the Law on Land Management and the restrictive provisions of the guarantee Law of the Law on property Rights. The practice of local rule of law in land circulation has broken through the limitations of the current national law, mainly reflected in the transfer of rural collective construction land use right to non-agricultural use, the circulation of diversification and the transfer of homestead. The local government actively promotes the circulation of rural collective construction land use right and the local government's dependence on land finance. The exploration of local rule of law is conducive to promoting the development and perfection of the country's rule of law. However, this kind of exploration needs to be carried out under the framework of rule of law, so that the rights and interests of individual farmers can be safeguarded and guaranteed finally.
