【摘要】：2017年政府工作報(bào)告中再次強(qiáng)調(diào)切實(shí)推進(jìn)“供給側(cè)改革”,土地制度改革面臨新的機(jī)遇。采取多樣化供地方式,鼓勵(lì)以租賃方式或先租后讓、租讓結(jié)合方式供地符合新階段產(chǎn)業(yè)發(fā)展的用地需求。然而,在現(xiàn)行土地制度框架下,圍繞土地租賃行為的相關(guān)制度建構(gòu)尚不完備,存在著諸多經(jīng)濟(jì)風(fēng)險(xiǎn)。將傳統(tǒng)的“土地管理”思維轉(zhuǎn)變?yōu)椤巴恋刂卫怼钡男滤季S,破解現(xiàn)行法律框架下的“租地困局”,從而構(gòu)建起適應(yīng)新階段土地供應(yīng)形勢(shì)的土地租賃行為新治理框架。
[Abstract]:In the 2017 government work report, it is emphasized to push forward the "supply-side reform" again, and the land system reform faces new opportunities. Diversification of land supply means is adopted to encourage the use of land by lease or first lease after concession, and the combination of concession and land supply conforms to the demand for land in the new stage of industrial development. However, under the framework of the current land system, the construction of the relevant system around the behavior of land leasing is not complete, and there are many economic risks. The traditional thinking of "land management" is transformed into "land management", and the "land leasing dilemma" under the current legal framework is solved, and a new governance framework of land leasing behavior adapting to the new stage of land supply situation is constructed.
