【摘要】：通過(guò)調(diào)查研究顯示,征地拆遷糾紛產(chǎn)生的根本原因是征地拆遷補(bǔ)償問(wèn)題。在征地拆遷過(guò)程中,往往征地拆遷方、被征被拆方就征地拆遷的補(bǔ)償標(biāo)準(zhǔn)、補(bǔ)償方式不能達(dá)成一致。作為征地拆遷項(xiàng)目的主要施動(dòng)者,政府在征地拆遷項(xiàng)目補(bǔ)償問(wèn)題上,容易出現(xiàn)不按補(bǔ)償標(biāo)準(zhǔn)對(duì)征地拆遷項(xiàng)目進(jìn)行補(bǔ)償、不按規(guī)定時(shí)間及時(shí)對(duì)被征被遷對(duì)象予以補(bǔ)償、在補(bǔ)償方式上并不能滿(mǎn)足被征被拆對(duì)象的需求。由此看來(lái)我國(guó)要想推進(jìn)城鎮(zhèn)化發(fā)展,就必然要面對(duì)征地拆遷的難題,而征地拆遷補(bǔ)償問(wèn)題是征地拆遷問(wèn)題的關(guān)鍵。因此,本文以征地拆遷項(xiàng)目的補(bǔ)償問(wèn)題為重要背景和選題的出發(fā)點(diǎn),對(duì)其進(jìn)行研究,試圖通過(guò)實(shí)地調(diào)查法對(duì)集美文教區(qū)征地拆遷情況進(jìn)行調(diào)查研究,并對(duì)新加坡和澳大利亞征地拆遷經(jīng)驗(yàn)進(jìn)行重點(diǎn)剖析,結(jié)合項(xiàng)目管理理論和方法,分析地征遷補(bǔ)償存在的問(wèn)題:征地拆遷補(bǔ)償政策及法律法規(guī)不健全、拆遷房屋權(quán)屬及面積確定難、補(bǔ)償方式單一、補(bǔ)償政策缺乏實(shí)地調(diào)研、缺乏對(duì)補(bǔ)償不到位的后續(xù)救濟(jì)機(jī)制以及失地后的村民社會(huì)保障問(wèn)題,并據(jù)此提出集美文教區(qū)征地拆遷補(bǔ)償工作中應(yīng)該規(guī)范征地拆遷主體的行為,使被征被拆對(duì)象的利益得到保障,形成一個(gè)良性循環(huán)的征地拆遷補(bǔ)償機(jī)制。
[Abstract]:The investigation shows that the fundamental cause of land expropriation and removal dispute is compensation for land requisition and removal. In the process of land expropriation and removal, there is no agreement on the compensation standard of land expropriation and removal. As the main operator of the land requisition and relocation project, the government is prone to compensate the land requisition and relocation project not in accordance with the standard of compensation, and compensate the object of the land requisition in time and in time. The method of compensation can not meet the needs of the target. Therefore, if we want to promote the development of urbanization, we must face the difficult problem of land expropriation and relocation, and the problem of compensation for land acquisition and removal is the key to the problem of land acquisition and relocation. Therefore, this paper takes the compensation of land requisition and removal project as the important background and the starting point of the topic, and attempts to investigate and study the situation of land expropriation and relocation in Jimei cultural and educational area through field investigation. The experiences of land expropriation and removal in Singapore and Australia are analyzed emphatically, and the problems of compensation for land expropriation and relocation are analyzed in combination with the theory and method of project management: the policy of compensation for land requisition and removal is not perfect, and the laws and regulations are not perfect. It is difficult to determine the ownership and area of the house for demolition, the compensation method is single, the compensation policy lacks the field investigation, the follow-up relief mechanism for the lack of compensation is not in place, and the villagers' social security problem after the loss of land is lacking. Based on this, it is proposed that the behavior of the subject of land requisition and removal should be standardized in the compensation work of land expropriation and removal in Jimei cultural and educational district, so that the interests of the subject of expropriation and demolition can be protected, and a virtuous cycle compensation mechanism for land requisition and demolition should be formed.
