【摘要】：研究目的:以公平和效率目標(biāo)為線索探討土地調(diào)整的合理性與必要性,以便更好地推動(dòng)相關(guān)研究和指導(dǎo)土地產(chǎn)權(quán)管理制度的建設(shè)與完善。研究方法:文獻(xiàn)資料法,對(duì)比分析法。研究結(jié)果:(1)從合理性來(lái)看,土地調(diào)整體現(xiàn)了村民的集體成員權(quán),并在社會(huì)保障、土地利用效率與社會(huì)資源配置方面發(fā)揮較大作用;(2)從必要性來(lái)看,一方面市場(chǎng)補(bǔ)償機(jī)制的缺失導(dǎo)致了調(diào)整對(duì)農(nóng)業(yè)生產(chǎn)績(jī)效負(fù)面影響的產(chǎn)生,另一方面,土地流轉(zhuǎn)作為替代性機(jī)制運(yùn)轉(zhuǎn)受限,土地確權(quán)作為政策約束面臨著實(shí)踐困境的同時(shí)也忽視了調(diào)整的社會(huì)、政治功能。研究結(jié)論:在現(xiàn)階段土地調(diào)整仍有一定的存在空間,未來(lái)要逐步健全調(diào)整的替代制度,并加強(qiáng)不同制度之間的銜接和配套建設(shè)。
[Abstract]:The purpose of this paper is to explore the rationality and necessity of land adjustment based on the objective of equity and efficiency in order to promote the research and guide the construction and perfection of land property right management system.Methods: literature method, comparative analysis method.From the point of view of rationality, land adjustment reflects the collective membership rights of villagers, and plays a greater role in social security, land use efficiency and social resource allocation.) from the point of view of necessity,On the one hand, the lack of market compensation mechanism leads to the negative impact of adjustment on agricultural production performance, on the other hand, land transfer as an alternative mechanism is limited.As a policy constraint, the land right is faced with practical difficulties while neglecting the social and political functions of the adjustment.Conclusion: there is still room for land adjustment at the present stage. In the future, we should perfect the substitute system of adjustment, and strengthen the connection and construction between different systems.
