大部制背景下我國豬肉類產(chǎn)品安全監(jiān)管體系之完善研究

【摘要】:豬肉所含營養(yǎng)成分充足,是我國人民的主要動物蛋白質(zhì)供應(yīng)源。近年來,頻發(fā)的豬肉類產(chǎn)品安全事件暴露出政府監(jiān)管的盲區(qū)和監(jiān)管的缺位。從總體上看,大部制改革前我國豬肉類產(chǎn)品安全監(jiān)管體制采用分段監(jiān)管模式,將豬肉類產(chǎn)品“從養(yǎng)殖場到餐桌”分為五個環(huán)節(jié),主要由農(nóng)業(yè)、商務(wù)、質(zhì)檢、工商、衛(wèi)生五個部門依據(jù)各自職責(zé)分別實施監(jiān)管。2011年的雙匯“瘦肉精”事件,造成了極大影響,其后的運動式的聯(lián)合執(zhí)法治標(biāo)不治本。無法解決監(jiān)管盲區(qū)和監(jiān)管重疊同時存在、部門間信息共享困難、部門行為難以協(xié)調(diào)等問題。為了解決上述問題,杭州市通過制定地方性法規(guī)規(guī)范豬肉類產(chǎn)品安全監(jiān)管、上海進(jìn)行地方性的大部制改革,但收效甚微。2013年3月,我國新一輪的大部制改革拉開了序幕,十二屆全國人大一次會議通過的《國務(wù)院機構(gòu)改革和職能轉(zhuǎn)變方案》中涉及豬肉類產(chǎn)品安全監(jiān)管的變化較大,對我國豬肉類產(chǎn)品安全監(jiān)管體制的影響最大,一個無縫監(jiān)管的豬肉類產(chǎn)品安全監(jiān)管模式基本形成。本次豬肉類產(chǎn)品安全監(jiān)管大部制改革使得各監(jiān)管部門的職能整合,解決了多頭執(zhí)法問題,提高了監(jiān)管效率,同時地方政府監(jiān)管職權(quán)增強,職責(zé)進(jìn)一步明確。部門間溝通效率、協(xié)調(diào)能力都大大提高。本文借鑒了荷蘭、德國、美國等國家的豬肉類產(chǎn)品安全監(jiān)管經(jīng)驗,提出完善我國豬肉類產(chǎn)品安全監(jiān)管的建議:一、健全法律法規(guī),規(guī)范標(biāo)準(zhǔn)體系;二、加強豬肉類產(chǎn)品安全源頭監(jiān)管;三、整合資源,提高效率;四、加快行業(yè)協(xié)會整合建設(shè)步伐;五、繼續(xù)推行和完善豬肉類產(chǎn)品安全監(jiān)管行政問責(zé)制度。
[Abstract]:Pork contains sufficient nutrients and is the main source of animal protein for the people of China. In recent years, frequent incidents of safety of pork products have exposed blind spots and lack of supervision by the government. Generally speaking, Before the reform of the big department system, the safety supervision system of pork products in China adopted a piecewise supervision model. The pork products were divided into five links: agriculture, commerce, quality inspection, industry and commerce. The "lean meatine" incident in Shuanghui in 2011 had a great impact on the five health departments according to their respective responsibilities. The subsequent joint exercise of law enforcement did not deal with the root causes. It could not solve the problem of the blind areas of supervision and the existence of overlapping regulations. In order to solve the above problems, Hangzhou has adopted local laws and regulations to regulate the safety supervision of pork products, and Shanghai has carried out local large-scale system reform. In March 2013, the first session of the first session of the 12 National people's Congress adopted the "Plan for Institutional Reform and functional Transformation of the State Council", which involved greater changes in the safety supervision of pork products. It has the greatest influence on the safety supervision system of pork products in our country, and a seamless supervision mode of pork products safety supervision has been basically formed. It has solved the problem of multiple law enforcement, improved the efficiency of supervision, and at the same time, the local government has enhanced its supervisory authority and responsibilities, and the efficiency of inter-departmental communication and coordination has been greatly improved. This paper draws lessons from the Netherlands and Germany. The safety supervision experience of pork products in the United States and other countries, put forward some suggestions to improve the safety supervision of pork products in our country: first, perfect the laws and regulations, standardize the standard system; second, strengthen the safety source supervision of pork products; third, integrate resources, Improve efficiency; fourth, speed up the pace of integration and construction of trade associations; fifthly, continue to promote and improve the system of administrative accountability for the safety supervision of pork products.
