【摘要】：限期整改是指總督察發(fā)出決定書,責(zé)令有關(guān)省級(jí)人民政府在規(guī)定期限內(nèi)對(duì)土地違法違規(guī)問題進(jìn)行糾正整改的行政約束性制度。限期整改的核心是暫停違法違規(guī)問題所在地區(qū)農(nóng)用地轉(zhuǎn)用和土地征收的受理和審批。限期整改是國家土地督察制度的重要組成部分,是國家土地督察機(jī)構(gòu)督促地方政府糾正整改違法違規(guī)問題的重要手段。國家土地督察制度實(shí)施以來,國家土地總督察共對(duì)7個(gè)地區(qū)實(shí)施了限期整改。通過對(duì)限期整改在2007、2014年的兩次實(shí)踐,以及與環(huán)境影響評(píng)價(jià)區(qū)域限批政策及土地督察中的重點(diǎn)案件督辦、約談地方政府領(lǐng)導(dǎo)、印發(fā)整改意見書等進(jìn)行比較分析,分析研究了限期整改的實(shí)施現(xiàn)狀及存在的問題。主要是土地違法違規(guī)形勢(shì)嚴(yán)峻使限期整改面臨政策兩難,國家土地督察立法滯后影響限期整改的權(quán)威,限期整改實(shí)施缺乏規(guī)范完善的操作標(biāo)準(zhǔn),督察機(jī)構(gòu)自身建設(shè)不足等。對(duì)此,本文提出完善限期整改制度的五個(gè)方面措施和三個(gè)方面建議。五個(gè)方面措施,即明確限期整改的適用標(biāo)準(zhǔn)、啟用程序、整改范圍、結(jié)束整改條件和輔助措施。三個(gè)方面建議:一是在全社會(huì)形成依法用地管地氛圍,從源頭上預(yù)防和減少土地違法違規(guī)行為的發(fā)生。二是推進(jìn)督察機(jī)構(gòu)法治化建設(shè),加快《土地管理法》修編和《國家土地督察條例》出臺(tái)。三是加強(qiáng)督察機(jī)構(gòu)自身建設(shè)。
[Abstract]:The term of rectification refers to the decision issued by the Chief Inspector. Order the relevant provincial people's government to correct the violation of laws and regulations of land within the prescribed period of time. The core of the rectification and reform within a time limit is to suspend the conversion of agricultural land and land expropriation in the area where the illegal and illegal problems are located. Deadline rectification and reform is an important part of the national land supervision system. It is an important means for the local government to correct the illegal and illegal problems. Since the implementation of the national land supervision system. The State Land Chief Inspector has carried out the rectification and reform within a specified period in seven regions. The practice was carried out twice in 2007 and 2014. And with the environmental impact assessment of regional approval restriction policy and land inspectors in key cases supervision, interviews with local government leaders, the issuance of corrective opinions and other comparative analysis. This paper analyzes and studies the current situation and existing problems of the implementation of deadline rectification and reform. It is mainly due to the serious situation of land violations and regulations that the policy dilemma is faced with the deadline rectification and reform, and the lagging legislation of the national land inspector affects the authority of the time limit rectification and reform. Due to the lack of standard and perfect operation standard and the insufficient construction of supervision institution, this paper puts forward five measures, three suggestions and five measures to perfect the system of rectification and reform within a specified period of time. That is to say, make clear the applicable standard of rectification and reform within a time limit, use the procedure, rectify the scope, put an end to the rectification and reform conditions and auxiliary measures. Three aspects of the proposal: first, the formation of the atmosphere of land use in accordance with the law in the whole society. At the source, we should prevent and reduce the occurrence of illegal and illegal land activities. Second, we should promote the construction of supervision institutions by law. Speed up the revision of the Land Administration Law and the promulgation of the State regulations on Land Supervision.
